Crownies (2011) s01e19 Episode Script

Episode 19

1 The director of the DPP promised my listeners justice in the trial of Nicholas Quinn, that lying rapist of an attorney-general.
But no court in the state is going to find him guilty.
He needs to crawl away in some dark hole and never show his face again.
Your Honour, despite the regrettable comments made on radio earlier this morning, the prosecution sees no impediment to this matter proceeding as planned.
There's no chance of a fair trial.
We're adjourning for six months.
On! Hey! What are you doing? Wanker! You're sleeping with Rosenberg's associate! Look, there's no pillow talk going on, OK? Gonna tell that to David when you're held in contempt, she's stood down and Rosenberg moves for a mistrial, you idiot? Your old man's a thug! You know that.
Everyone knows it.
Some of his enemies are in concrete slabs just down the road.
But he's given you a chance to ignore all that and be your own woman.
You take that chance! Lina.
These guys, they took off.
We followed and blocked them in an alley.
Then they started shooting, so we shot back.
And then she was just just lying there on the ground, bleeding.
Mate of mine saw the ballistics report.
It was my gun.
I don't understand.
What'd I do wrong? Is that Lyndi Quinn? Nicholas died at 4:00 this morning.
I'm sorry for your loss.
Are you? Mrs Quinn You killed him, David.
You ruined his memory, his legacy.
His children can't I only proceeded on the evidence.
It wasn't personal.
Nicholas placed a premium on loyalty.
You are going to find that Nicholas had friends everywhere.
Loyal friends, with long memories.
You and your family have my sympathy.
What have you lost now? My puffer! Are you asthmatic? Have you gone over the Smith assault? Mm-hm.
So dazzle me.
That's not gonna be easy.
I have faith.
On the surface, it looks like a straightforward prison assault.
Witnesses state there was shouting in the exercise yard when a gang of men set upon a lone prisoner, Warren Smith, while the guards weren't looking.
The police, however, want us to proceed with attempted murder.
Well, what do you think? Attempted murder? Looks to me like the perpetrators just got lucky.
They nicked a major artery and the victim had a cardiac arrest en route to hospital.
Did we take into account the fact the victim was locked up in the prison yard with nine other inmates, five of whom left at exactly the same time, a half-hour before the end of their allotted time? That's only proof that those five intended to leave.
Explain, then, the statement made by one of the prisoners, Robby Lucas, who claims he was told to leave the yard in advance by Mr Nelson Taufua, one of the alleged assailants.
Mr Lucas is a recidivist offender.
I imagine he's trying to gain some advantage by cooperating.
Or he's telling the truth.
There's no basis to proceed.
What if I told you the victim of this vicious assault was cooperating with a drug investigation in the prison and the prison authorities believe those four inmates were trying to shut him up? So we're gonna do this? Well, let's see how strong a witness Robby Lucas turns out to be.
Without him, the whole thing falls apart.
Yes? Excuse me.
David wants to see us.
Draft a witness authorisation for David to sign.
Mm-hm.
Sure.
Hey.
Close the door behind you.
Words that always bode well.
Nicholas Quinn died early this morning.
Any deathbed confessions? He was supported by his wife and children to the end.
At least he can't hurt anyone else.
No-one talks to the media.
Of course.
Not one word.
We'll have to lodge a notice of discontinuance.
Yes, of course.
Well, they'd better not give that bastard a state funeral.
You know why Lyndi Quinn was here to see David? Shall I? Yeah.
Uh, ladies and gentlemen, a little announcement for you all.
Nicholas Quinn is dead.
Carry on.
Chop chop, Miss Novak.
Get your skates on.
We're going out to the Benchley Boys' Club.
He means prison.
David wants a notice of discontinuance on Quinn filed today.
As soon as we can get it on the list.
Yes, of course.
So does this mean the file investigation's finally over? - Uh, we would not be that lucky.
- Richie.
How's your day looking? I'm seeking an adjournment on my bongmeister case.
Oh, big, bad drug dealer.
Who's in the big chair? Judge Walker.
You're a cougar magnet.
She loves you! What are you talking about? Treat 'em mean, keep 'em keen.
She likes to keep you very keen.
It's a straightforward adjournment, OK? It won't be a problem.
Positivity.
I like it.
And, uh, seeing anyone tonight? Tatum told you.
So you two are so new, you really think you should be taking such a big, bold step? It's a, uh a friendly drink, alright? We're cycling buddies.
Where you taking her? Nowhere.
Boom.
Your house.
Good.
Smooth.
Uh, no.
No-one's taking anyone anywhere, alright? Lisa and I are arriving at the same place at the same time.
Oh, that's romantic.
So you guys are cycling buddies, hey? Yep.
Gonna be getting into her, uh, sprockets, then? I have to get to court.
OK.
And I think the cycling-related double entendre that you're perhaps straining for is, um, pump.
Pump.
Good morning, Your Honour.
Um, in the matter of Llewellyn on Your Honour's lists, Richard Stirling for the Crown.
I know who you are, Mr Stirling.
Filip Makris for the defence, Your Honour.
Now, as Your Honour would remember, this is a matter of drug manufacture and distribution, and the defendant changed his plea during the trial to guilty.
However, my counsel's been unavoidably detained, and I'd ask that this plea hearing be adjourned to another date.
I understand the defence has no objection.
That's correct, Your Honour.
You were the instructing solicitor in the trial, were you not? Uh, yes, Your Honour.
I don't see any reason why you shouldn't proceed.
Um, respectfully You know well the backlog of cases in the system.
I don't see any need to contribute further to this.
Uh, yes, Your Honour, but, um I haven't had the chance to confer with counsel.
Then I suggest you confer with your notes.
Now, Mr Stirling.
You feeling any better? I had an idea.
Great.
It involves you too.
OK.
Paris.
What do you think? About what? Paris.
The Aussie dollar like it is.
And anyway, you got plenty of leave, right? Going to Paris? Yeah.
I can book the tickets online.
We could even drive down to Spain.
Barcelona.
Bullfighting! Whoa! Andy.
What? What about the counselling session? You know? Maybe you need to talk to somebody about how you're feeling.
How much leave do you think you've got? About a month? City of love! We're in love.
Well, I love you anyway.
You're not as indispensable to that place as you think you are.
None of us are.
Listen.
Um Andy, I know this is a really .
.
really awful time for you, but Don't you think we should just stay here? You know, deal with what we're dealing with Fine! Step this way.
Take off your shoes.
Go through the scanner again.
Step this way again.
Hold your arms up.
Do you have any knives, guns, syringes, liquids, photographic or telephonic devices on your person? Um, a phone.
Place it in the locker with the rest of your possessions and sign the register.
Enjoying your first visit? That guard knows me better than Conrad.
Come to visit the Gillies Wing? Your boss gets a lot of love out here.
Love to kill me, he means.
Alright.
Just breathe.
We'd like to speak to you about a statement you made concerning a serious assault here in the prison yard at Benchley.
I've got a copy with me.
Didn't bring my glasses.
Oh, that's alright.
We'll walk you through it.
Now Not in the face, eh? Oh, sorry.
Ah, Mr Lucas.
Uh, uh, Mr Lucas, on the afternoon of the 3rd, you were in Z yard when you state you were approached by a Nelson Taufua, who informed you it would be wise to leave the Uh, who'd you say? Nelson Taufua, a fellow prisoner.
Did I say that? Yes.
That's what's in your statement.
Yeah, I don't remember that.
I remember being in the yard, but, um someone talking to me You're not under investigation, Mr Lucas.
We just need to confirm a few facts.
I don't remember the day that well, so I'm not really sure what I saw or heard.
But this is what you state you saw and heard.
I don't know.
I'm gonna get a glass of water.
We know you didn't witness the assault.
We're not asking you to add to your Hey! Let go.
Smooth legs.
Danny Novak's my father.
Let go of me or you're fucking dead.
I got nothing to say.
Go call the guard.
I thought you were taking time off? I was.
I l am.
I just thought I'd fill in the summary of the Gardiner file.
Get the exhibits back in order.
That can wait, Lina.
I know, but I've got some time now, so How is he'? Running.
Well, exercise is good for stress.
Four hours at a time? If you need anything, just let us know, OK? Erin, when you're done, come see me? Sure.
Hey.
You OK? Yeah, I'm fine.
Really.
Go see Janet.
You've reached Detective Sergeant Andy Campbell.
Please leave your name and number.
Andy, call me when you get this.
Please let me know where you are.
I've had a look over your second attempt at the indictment.
It's, you know, mainly fine, except the police intercepted the stolen car parts before he received them.
So it should be attempted possession, not possession.
Oh, God, sorry.
Of course.
That's alright.
No, no, no, I l should have seen that.
I, um I'll get straight on it.
I know you're taking some overflow for Lina.
What else have you got? A Supreme Court bail hearing, but I can do it.
Tomorrows fine.
It's been a week, you know, since I had a drink.
That's great, Erin.
I really am sorry.
So you've said every day this week.
I've edited it for you.
So when you said the drafting was fine, you meant That you should start again.
The resident aliens? Some days I think they're just gonna rip right through me.
Scary.
Erin O'Shaughnessy.
You're a lawyer.
What can you tell me about similar fact evidence? You know what she needs? A baby shower.
Do you know if Richard's around? Is he I thought baby showers were about the presents, the tizziness, the cupcakes, tacky fake champagne.
But actually, underneath all that pink, it's about reassurance, telling a new mum that her pregnancy's gonna be alright.
People generally don't have baby showers for their second child, do they? They know what they're in for.
And similar fact evidence? We're gonna throw Janet a surprise baby shower.
Absolutely.
Good idea.
I've got court right now No, I need help.
The first step's admitting that.
That's good.
Ben, help me and I'll tell you about similar fact evidence.
I can't organise a baby shower.
I'm a male person.
Buy the present, then.
I do know what women want.
And I've got a store card for just about every lingerie shop in the CBD.
Ben! Jokes.
Relax.
One store card.
I'll buy a good present.
What do you think? Baby shower for Janet.
I'm thinking tomorrow morning, in the kitchen.
Oh, not this kitchen.
Not this office.
I'm sorry, Erin.
No baby shower.
I'll keep it very tasteful.
This is a serious workplace.
Can you imagine what it would look like if a witness in a violent matter came in here and saw solicitors wearing necklaces made out of baby pins and playing Guess Mummy's Tummy Size? It's just not appropriate.
The DNA evidence for Lina's Supreme Court bail hearing.
Guess I'm off present duty.
More time to discuss similar fact evidence.
Why are you off present duty? You heard what Tracey said.
Did I? Maybe I didn't.
Weren't you off to court anyway? Fuck! Looking at the prosecution case, I submit that my client could only be regarded as a small cog in a larger narcotics distribution machine.
The other mitigating factor here is the hardships he and his family have already suffered.
The loss of Mr Llewellyn's job, his house, the fact that his wife and children are now reduced to penury and are forced to reside in a refuge.
I submit there's very little to be gained by imposing a custodial sentence.
Thank you, Your Honour.
Your Honour, if I might reply? I have heard the Crown's summary and sentencing instructions, Mr Stirling, insufficient as they were.
Uh, yes, Your Honour, but if I might address a few matters raised by the defence.
If you must.
There's no evidence before the court to verify these claims, and because the defendant's wife is not present today I imagine she's looking after the children.
Yes.
Thank you, Your Honour.
She is.
Be that as it possibly may, there is no evidence that his family's financial welfare is solely dependent on him.
And with respect to the defendanfs property, taken under the Confiscation of the Proceeds of Crime Act, I believe there was a recent amendment to the Sentencing Act.
Really? Yes, um Governing how Your Honour Let's have it, then.
Pardon'? Show me the act.
Yeah, as as I wasn't, um, expecting to appear today, I wonder if Your Honour might grant me 10 minutes.
No, I will not.
I intend to rule on what I have in front of me.
I will reserve judgment until 11:00 tomorrow morning.
Oh, and I had the perfect evening all worked out.
It was gonna be a triumph.
Start with a twilight visit to the museum, move on to cocktails overlooking the park.
Let Lisa see the real me.
Cultured, sensitive, man of the world.
End the night with a walk around the quay to the footlights of the bridge, hmm? And then, Judge Walker.
I mean, is it reasonable to deny a 10-minute adjournment so the act can be located, let alone accept defence's submissions without a skerrick of evidence to back them up? And now, instead of having an evening to remember, I'm gonna be exhuming the bongmeister's bank records, combing the Sentencing Act and waiting on an update from the cops.
All courtesy of Judge 'Treat 'em mean, keep 'em keen' Victoria Walker.
Oh, thanks! Really! No, your support makes a difference.
Fuck! I'll take care of this.
Uh, sure.
You go back to the office.
If you could follow that up for me, Ms Rousseau.
Your Honour.
David Sinclair.
Mr Sinclair! This is a rare treat.
Your Honour, I appear in the matter of Quinn, which you might be aware has been kindly added to your list at the last minute.
Yes.
I have the file here.
As you might expect, the prosecution is not proceeding with the matter, and I hand up a notice of discontinuance.
I'll mark the indictment as struck out.
I would seek to note that this is only due to the passing of the accused and not to any deficiency in the Crown's evidence.
Ms Rousseau.
Ls everything alright? Thank you, Your Honour.
Thank you, Mr Crown.
Julie.
Julie! The prick got away with it.
Not exactly.
He's dead.
Not for the women he raped.
It never ends for them.
We tried our best.
Only when you were forced to.
The DPP wanted to bury this from the start.
That's not true.
“We could prosecute, but do we want to?” What do you call that? OK.
That was our original advice memo.
After that, we took the case to committal, and when it was thrown out, we went for direct indictment.
We did everything we could.
You failed.
And Quinn, the only thing that actually hurt him, that wiped that smug smile off his face, were the details of his what he did to women, getting out in the press.
And nearly derailed our case before it began.
Can you honestly say to me that the DPP would have acted if that file hadn't been leaked'? No, I can't.
Then it was worth it, wasn't it? Whoever took that file from your backpack in the bar, it was worth it.
Whoever took it? What? They did the right thing.
Don't you think? Julie, what Julie, tell me you didn't Julie, tell you didn't give Jimmy Butcher the file! What Fuck! Fuck! Are you You have screwed me! You have screwed all of us! We could have lost our jobs! But you're all so brilliant, you would have got other jobs.
What'd you just say? You weren't the ones who needed protecting.
Who the fuck are you? What I don't understand.
Why? Was it for money? Huh? What was it? Quinn raped my sister, Miranda.
What? He was gonna get away with it again.
Robby Lucas's file.
Go through that, see if there's anything in there that'll help the police word a letter of comfort for his next Parole Board hearing.
Why? He said he won't help us.
Just looking for a juicy carrot to assist his memory.
Robby Lucas doesn't deserve to get out early.
However accurate your assessment may be, the bottom line is the police need his statement.
He won't help us.
Maybe not.
But we have to be seen to be playing nicely with the other children, and he's their leverage.
Bring me the information in the morning.
So, cheers.
Cheers.
So, how was your day, sweetheart? They're not overworking my princess, are they? I'm not a princess, Dad.
Mmm.
She had to go out to Benchley today.
Didn't you, babe? Full on.
Whose bright idea was that? I went with Tony.
I thought Gillies would know better than that.
That's no place for a young woman.
No, it was fine.
Are you sure, babe? 'Cause you do seem a bit you know Can we stop talking about me? I thought tonight was supposed to be about picking a venue.
I thought that we could actually start by choosing a date.
What, it's up to me, is it? It's always up to you, babe.
Well, fine.
Six months from today.
Seriously? You wanted a date, we've got one.
Is that OK with you, Dad? Yeah, that's That's fine.
Great.
This is a good drop.
Any more of this? Mmm.
Yeah.
I'll, uh, have a look.
Thanks.
Did something happen today? No.
Prisons are not nice places, but the men in there are in there for good reason.
Now, I don't want you feeling sorry for 'em.
I don't feel sorry for them.
Good.
'Cause they see you coming, a beautiful young woman like you, all your potential, makes 'em feel ugly.
You represent everything they'll never have.
You know that? So those men can't change? Well, some can, I suppose, if they're lucky.
If they've got good reason.
What's a good reason, Dad? Well, family, I guess.
I don't really know.
Why did you push me to go into the DPP? I didn't push you to go into the DPP.
But you said it would make you happy.
You graduated top 10% of your class.
You you earned that job.
Who wouldn't be happy? I remember it differently.
I remember you saying that the DPP would be the perfect place for me to work.
Well, maybe I thought you'd get respect there.
Respect? Mmm.
Prosecutors uphold the law.
Defence lawyers just deal with scum, don't they? You know a lot about it.
If you want to ask me something, just ask.
Ah! We ran out of red, Danny.
Port? Great.
Tell me exactly what happened.
This is no time to be coy.
Janet gave me the Quinn file to work on when it first came in.
She told me specifically not to take it out of the office.
Advice you chose to ignore.
Well, I wanted to work on it, Dad.
I was under massive time pressure.
So how did a journalist get his hands on the file? Then who? It wasn't me.
Is it important? I bloody well think so, don't you? Who? It was Julie Rousseau.
And how did she know what you had? Because I told her.
It was a party.
You know Look, I was bragging, alright? You took a file like that to a party? Yeah, well, I didn't plan on staying long.
But long enough to tell an almost stranger about the potentially explosive file you had in your bag.
Trying to get her into bed, I suppose.
Sometime that night, Julie gave the file to Jimmy Butcher.
Is she threatening you? What? No.
She Does she have anything else on you? Like what? Anything at all.
ls there anything else I need to know? No.
This is what we'll do.
Firstly, you break off all contact with Julie Rousseau.
She's my girlfriend, Dad.
Then Then we get in first.
Your only crime as far as I can see is foolishness and over-diligence.
Julie Rousseau, however Well, she's grubby anyway.
She's grubby? She took the fine for Rosenberg, didn't she? We can use that if we need to.
And you're a McMahon, which will carry some weight.
You know, Rosenberg accepted full responsibility for that.
He pressured her into it.
She still did it.
You You want me to dob her in? She's a liability.
You're still a chance of keeping a career if we're smart about this.
Do you understand me, Ben? It's gonna be alright.
Richard Stirling.
Hi.
It's Lisa.
Oh, hi, Lisa.
I know you had to cancel this evening, but I'm in the bar next door.
(Bar's Bar'? Now'? Can you spare a few minutes? Um Yeah.
Well, um Absolutely.
'Bye.
Wow.
That's not lycra.
You look Wow.
Thank you, I think.
I know you've got work on tonight, and I feel terrible springing this on you, but my life's not very flexible.
If I make a date to see someone, it's a bit of a big deal for me.
I've got to get a babysitter.
Anyway.
Well, I've got a babysitter, and I'm dressed up, which I hardly ever get to do, so I thought if there's any way we could still do this, then maybe we could still Do this'? Great.
Sorry, I'm waiting on a call.
From the police, on a case.
They could be hours.
Hopefully, they will be.
Who'd you get to babysit? My niece.
I've got a niece.
She's seven.
Little young for babysitting.
Yeah, and she's in New Zealand.
Oh.
You really do look incredible.
Do you want a drink? Yes.
Oh.
Excuse me.
Uh, yeah.
Oh, right, Detective.
Um, could we perhaps Can I maybe meet you later, or even tomorrow morning? OK.
I'll see you.
Oh.
Let me guess.
I'm so sorry.
They might have new evidence, and it's Judge Walker tomorrow, and you have no idea what she's like.
Oh, you're standing me up for another woman? No, Judge Walker's not a woman.
She's a Judge.
I was gonna go with 'beast from hell'.
How long do you have your niece booked for? How long will you be? I might only be an hour.
Or or two.
Two and a half, tops.
Or we could just make it another time.
Really? You mean that? Go.
Great.
I'm I'm sorry.
Go! Where's my kiss? Mmm Can I ask you something? Mmm'? What do you do for Dad? I sell cars.
Is that all? No.
Sometimes we take long walks on the beach together and do candlelit dinners.
What are you talking about? Don't worry about it.
Tate.
I sell cars.
I mean, what do you think happens in a car yard? That's all you do? Well, what else would he want me to do? Look, your dad's a good bloke.
Why are you giving him such a hard time? Jesus! What? Oh, shit.
I can't sleep.
Yeah, well if the TV comes on and starts glowing by itself A guy grabbed me.
What? What guy? At the jail today.
A prisoner.
Um, what do you mean What do you mean, grabbed you? Tatum'? I can't believe I wore that stupid dress out there.
Wasmwas that all'? I mean Did he Was there anything else Yeah, he just grabbed me.
He was so Tatum, I Hey, come here.
Did you get my messages? Yep.
Why didn't you call? I didn't have anything to say.
Where were you all night? Hey! Don't shut me out.
We're either in this together or we're not.
Together? Yes.
Guys.
ls everything You can't help me, OK? No-one can help me.
Andy, just Just tell me about it, then.
I need to have a shower.
You need some perspective.
You're gonna give me that, are you? Well, I can try! Why don't you try getting me some breakfast?! Fuck you.
That'd be fine as well! How are you gonna help? I killed her.
A bullet from my gun killed her! You did what you should have.
Then why is she dead? I don't understand it.
How did she end up in my line of fire? Is this the place? Yeah.
We followed the suspect's vehicle in here.
Stopped there and they started firing.
What'd you do? Got out of the car.
We took cover behind the doors.
I call for backup.
“Request assistance.
“Urgent, shots fired.
” Well, where's the second police vehicle? What? Her car.
It was just over there, where that white car is.
What, so the suspects are trapped? Yeah.
There's no way out.
I call out, “Police! Drop your weapon!” But they don't.
And I see Detective Simunic and her partner behind their car too.
Where the fuck is backup? Can you give me a hand? Yeah, sure.
Could you just go over there by that wall? How the fuck did you get there? What? You You you just told me to st Oh, shit.
This This is where she got shot.
No, you were back over there, behind your car! Andy, I don't think this is gonna work.
Do it now! Go over there! I exit my vehicle.
I take cover.
Don't just stand there.
Move.
Faster.
Do it again.
Do it again.
Run, fuck you! Run! Why are you there? What are you doing there? I don't know.
Maybe she just panicked.
You you couldn't have known she'd be here.
If those bastards It was an accident, Andy.
If those bastards hadn't have shot, if they'd just dropped their weapons! Chain of causation.
They start shooting, you start shooting.
It wasn't your fault.
No, but it was my gun.
Oh, baby.
Shh.
Hurry up, hurry up.
Shh.
Be quiet.
Surprise! I know you don't want a fuss, but we couldn't let this pass without marking the occasion.
Congratulations, Janet.
Yeah, cheers.
Um, speechless.
Ah, a lot of people here know you better than I do, but for those of us who are starting out, you've been amazing.
A great mentor, and you do expect a lot, but you're always ready to put in a lot too, which is a pretty great quality in a mum, when I think about it.
Yeah.
So I hope the whole experience is everything you want it to be.
- And the birth will be fine, totally.
- Totally.
Yep.
I don't know how to follow that.
Um, just thank you.
Thank you.
Oh, one more thing.
A token from all of us.
Oh, what's that? I will enjoy that in six months time.
Thank you.
Thanks.
You bought a pregnant woman champagne? Yes, I did.
You really hated this, didn't you? It was lovely.
Yep.
Well, I'll go out there now.
I'll let you know.
Menthol.
How are we going on this Parole Board business? I'm still working on it.
Detective Pickford had a call from Robby Lucas this morning.
Seems he apologised for wasting our time yesterday.
He's had a change of heart and prepared to stand by his original statement.
Really'? Not only that, he's offering to corroborate our victim's information in return for help with his parole.
Incredible.
I can only surmise Robby had a Damascene epiphany last night and found whatever we said to him appealed to his conscience.
There is one speed bump.
He said he'd only speak to you.
But I'm afraid he's gonna have to put up with me.
He's asked for me? I'll do it.
Absolutely not.
He probably just wants a second chance to ogle a pretty girl.
I'm not a pretty girl, Tony.
I'm an officer of the DPP.
I'm trying to protect you.
No, you're treating me like a child.
I know how to handle myself.
You would let Janet go out there.
Well, I wouldn't have a say in it.
Well, then, treat me the same way.
It's my job.
I want to do it.
If you go out there, chances are he won't give you anything at all, not if he's asked specifically for me.
The guards will be with me.
I'll be fine.
I'm glad you showed.
Keep your hands where I can see them.
I'm sorry.
I would never have tried it on if, you know, I'd known.
Just say what you've got to say and let's get this over with.
What do you want me to say? The truth.
That your statement is correct.
And if I do that, then it's all cool? Like, with your dad? Forget my father.
He's had people killed for way less than what I did.
That's not true.
It doesn't matter.
I'll do anything you want, I'll swear to anything you want.
Just Don't hang me out to dry.
So you'll stand by your statement on the assault? Absolutely.
Whatever you want.
All rise.
Arthur Thomas Llewellyn, please stand.
You have pleaded guilty to one count of manufacturing a prohibited substance Your Honour, I hesitate to interrupt.
Then trust your instincts and don't, Mr Stirling.
Yes, Your Honour.
But I I feel compelled to address a few of the matters raised at yesterdays hearing.
Mr Stirling, the time for submissions was yesterday, as I made clear.
So you did.
Then sit down.
Ordinarily, I would, happily, but overnight, some matters have come to my attention Are you deaf? Your Honour.
I regret that I am unable to sit down, shut up or even get back in my box, but I am duty-bound to bring these matters to the attention of the court.
Very well.
it's your career.
If I don't say what I need to, I may as well not have one, Your Honour.
Last night, I received a report from the officer in charge.
Contrary to the defence's claims that his family is living in a refuge, they are, in fact, doing rather nicely in an up-market apartment complex in Mosman.
Really? Complete with pool, indoor gym and barbecue facilities.
I can call up the OIC to give evidence to these facts, if Your Honour chooses.
Your Honour, please.
Sit down, Mr Makris.
At least somebody around here does what they're told.
Mr Makris, it would appear your client has been less than candid with you, would it not? Perhaps, Your Honour.
I won't need to hear from the officer.
In relation to the defence's submission regarding assets, uh, I draw Your Honour's attention to Section 24 of the Sentencing Act, which, as I mentioned yesterday, expressly precludes this type of submission for Your Honour's consideration at sentence.
I, uh, have a copy of the relevant section, if that would assist.
You tread an extremely precarious path, Mr Stirling.
You'd be advised to watch your step.
But it would seem that your diligence has paid dividends.
I'll take a short adjournment and then I will deliver my sentence.
Lisa.
Thanks for the text.
How was court? I won! Good on you! Finally stood up for myself and slayed the dragon.
Uh, metaphorical, rather than actual, just in case you were Anyway' So how do you normally celebrate? Muffin? Friand? Um Actually, I was thinking, um I mean, if it's not too I mean, if it's OK, that, um l might kiss you.
Still want the muffin? What are you smiling for? Oh, nothing.
I just rule.
You know 'World of Warcraft' has no bearing on real life? You are not gonna drag me down.
No, eventually you'll do that for yourself.
Not today.
Today, I am a god.
Where'd you get to? I went back to the jail.
What'? For God's sake, Tatum! Just call the police.
Can't.
Yes.
Yes, you can.
No, I I screwed up, Richard.
You didn't do anything wrong.
I did.
Something definitely unprofessional, potentially criminal.
You have to stop asking me questions now or you'll have to report me.
Just don't ask me anything else, please.
You talk to David? Talked to Julie.
She's not gonna say anything.
You still need to make that statement.
Jesus Christ, son! You're a child playing on the tracks, and you can't see the train coming.
She won't talk.
How do you know? You have one simple thing to do to save your career and you're too stubborn to even go to the police.
Look, I'm not reporting her! Then I will.
No! Do you know why she leaked the file, huh? Nicholas Quinn raped her sister, and he got away with it.
That's a pretty good reason, don't you think? That's what she told you anyway.
How do you know she wasn't just sleeping with the journalist? Some women are like that.
You are unbelievable! I wish, Ben, just once, you'd think with your head instead of your groin.
I love her, Dad.
I do.
Oh, grow up.
Sleep with them all you want, but for Christ's sake, never trust them.
This is hard now, but we'll get through it if we're smart.
You know, I'm surprised Mum lasted as long as she did with you.
Get out! Oh! Cheer up.
We're only going to cripple a large criminal conspiracy.
And I found my puffer.
You can't use Robby Lucas's statements.
I beg your pardon? They're tainted.
They were obtained under duress.
I gave the witness the impression that his life may be in danger.
You what? Tatum? When you were out of the room with your coughing, um, Robby Lucas reached under the table between my legs, and to make him stop, I told him who my father is and that I'd have him that I'd get him.
That's why I wanted to go back there by myself, 'cause I had to tell him that there was no threat, but it, um It looks like he doesn't believe me.
Are you alright? I think so.
I'm really sorry, Tony.
Oh, of course you only did it because you were frightened.
And I was an idiot to leave you in the room, but You understand, this is very serious.
Potentially criminal.
Yes.
Not to mention completely out of character.
For God's sake, Tatum! You threatened to have a witness killed? This assault.
Did you report it? Why not? I was worried it would get back to my dad and he'd Robby Lucas is a scumbag, but I don't want that on my conscience.
Do you toss threats like this around all the time? You know I don't' What are you gonna do, Tony? Report you to the Law Society is what I should do.
Instead, I'll call Detective Pickford and try and convince him that Robby Lucas's talent for changing his story makes him too unstable a witness for us to proceed and he's gonna have to junk the entire investigation.
I'm so sorry-Not nearly enough! Did you only come clean because you were worried this would emerge at trial? No.
Then why? Because Danny Novak's my dad, and I love him, but I work for the Crown too, and I need to find a way that I can be both.
Or I I don't l don't know, Tony.
Yes.
Could I speak to Detective Pickford, please? It's Tony Gillies.
From the DPP.
How was the counsellor? Yeah, OK.
Basically said there probably wasn't an answer to all this right now.
Things take time.
Until then'? Get some sleep.
Don't get too stressed.
Be good to myself.
I've been pretty off the air.
I said some things I shouldn't have.
And I didn't say some things I should have.
Andy, you know I love you too.
Come on.
I love you.
Ohh We'll get through this.
