Accused (2023) s02e06 Episode Script
Val's Story
Remember, you're calm and contrite.
Calm and contrite.
Can you say that and breathe, too?
We need you to appeal to the jury.
Is she testifying for me?
The state's bringing her.
She's testifying against me?
We have to keep movin'.
(TENSE MUSIC)
You have to help me, Jordan.
Val, we can't talk to her.
(MAN): Your First Aid and CPR
certifications are current?
Yeah. Just renewed.
Mm-hmm. You were a paramedic?
An EMT. I, I loved it.
Um, being calm in an emergency.
Yup, I love helping people,
you know, all of that.
Yeah. Can I ask why you're not
looking for an EMT position now?
Uh, ambulance hours are long,
and I have primary custody of, um
Yeah, so I, I need something flexible.
Okay. Um
I'm seeing a long gap
here with no employment.
Right. So, I um, I stopped
working when I had a baby.
My ex-husband, uh,
thought it would be best.
- Okay.
- I'm a really hard worker.
You're overqualified to
just be driving patients
to medical appointments.
Yeah, I know. Um
I just, uh, my
My alimony has run out, and
I could really use this job.
(SIGHS)
Do you have your own car?
Yes, I do! The car's not overqualified.
(LAUGHING)
I mean, it's not fancy.
Uh, but it is reliable. Uh, like me.
Okay. Uh, thank you for coming in.
- We'll get in touch.
- Oh, thank you.
- Yeah.
- Thank you so much.
And thank you for letting
me bring in Oliver.
You're welcome.
- Buddy, can you say thanks?
- Thank you.
Whatcha drawing there, Oliver?
It's a "Destroy Anything
in Its Path" Robot.
These are all things it's destroying.
Oh! Yeah.
Okay buddy, let's get
you to your dad's, okay?
Did you get the job?
Well, fingers crossed! Let's go.
Jason's dad is moving
out of their house.
Why do you have to
move, and Dad lives here?
Uh, well, that's just the
way the judge decided things.
And besides, I like our
little place. Don't you?
I guess.
So, uh, your dad is gonna drop you off
- on Sunday night, okay?
- Okay.
And you can call me, for any reason.
- All right? No matter what.
- (PHONE BUZZING)
Oh, not now, predatory lender.
Who's Preta Torilender?
(CHUCKLING)
Um
It's like if you borrowed a candy bar
from that destroying robot,
and it wanted five back.
- Oh.
- Yeah. But it's fine.
I'm, I am fine! No robot
is gonna destroy me.
All right, you got a
stuffie and a toothbrush?
I have like a million
stuffies from Jordan.
Right. Of course you do.
I know you don't like
Jordan, but she's nice.
No, I no, I-I do, I do like her.
I do. And, and what matters
is that you like her.
- Yeah.
- Okay.
Oh wait. Wait, wait, hold on, buddy.
We have to ring the doorbell, okay?
- It's my house.
- Yeah, I know.
Just stay with me. Okay?
Ha! Hi, Ollie!
Hi, Jordan.
Oliver is ready for his weekend.
Oliver. I missed you.
I think, uh, I think
he's got everything.
We have everything he needs here!
So, I hear.
Hey, I need you to sign this waiver.
We're going to an
E-games place on Sunday.
- Cool!
- Why does it need a waiver?
I don't know. It's just bumper cars
and laser tag. I'm sure it's safe.
Okay, you need to tell me ahead of time
about these kinds of things.
It just came up. I'm
looking at it for an event.
Yeah, okay, well still, we
should've had a conversation.
C'mon, Mom. Just sign it!
Okay. Signed.
- Thank you.
- Mm-hmm. Okay, I love you.
- Love you too.
- Have fun.
Hey, there's a present
waiting for you upstairs
in your bedroom. Go on.
Uh, listen I needed to talk
to Trey about that sculpture.
- Okay. He's in the garage.
- What kinda mood is he in?
His moods fine, Val. It's always fine.
I didn't make up what he was like.
- I just
- I didn't.
- Okay.
- Okay.
(DISTANT WHIRRING)
(WHIRRING)
Trey. Trey.
I need to talk to you.
So, I'm, I'm a little
behind on my car payments,
and I need my car for this new job,
so I wondered if I could have this back.
Why?
Well, Annie's really having a moment,
and her pieces are selling
for a lot of money online.
I don't want to sell it.
You never even liked it.
We're not selling it.
Trey, she was my friend.
I should've put it on
the list I gave the judge.
Yeah, well, you didn't,
and it was a wedding present
to the both of us, so
I was very agitated at the time.
Look at yourself, you're pathetic!
No kidding.
Okay, I I'll split it with you,
the money. 50-50, okay?
I just, I need a car. I need
to take Oliver to school,
and, and to pick him up.
And what are you doing
with the child support?
Paying rent. I'm feeding
and clothing our son.
Look, Val, if this is all just too hard,
Jordan and I can just take custody.
You can't have him.
Well, he could use some stability.
Look, Val, let's just be honest, okay?
You lost your last job, you
can't hold down your new one
and you are one mess-up away
from being a drunk again.
I'm only like this because of you.
Because of because
of what you did to me.
(CHUCKLING)
No. No, no, no.
(GRUNTING)
You were crazy when we met.
Which at the time, was
kind of hot. But now?
So, I'll just take this.
(TENSE MUSIC)
It's mine!
- Take it from me.
- Mom!
Look at my new toy.
It's cool bud. I'll see you Sunday.
(KISSES)
(QUIETLY SOBS)
I don't know.
(BREATHING HEAVILY)
(PHONE BUZZING)
Argh!
Okay. Okay.
(LIGHT MUSIC)
Oh. I get it.
That blabbermouth Junior
filed a complaint
'cause I pushed him around.
I'll get you a punching
bag for Christmas.
and we'll be adding
the Tuesday night group,
that people have been asking for.
And now, I'll open it up.
Uh, yeah, I'll go.
Uh, yeah, I'm really
struggling this weekend.
Val, uh, you're on mute.
Oh sorry. Uh here we go.
Yeah, I-I said I'm, I'm struggling.
Uh, my kid is at his
dad's this weekend, and
I just, I hate dropping him off there.
I worry.
He drew this, uh, this picture
of a "Destroy Anything
in Its Path Robot,"
and I thought, "Oh, it's your dad!
Looks just like him!"
And then I thought, I don't know, maybe,
maybe I'm the destroy everything robot.
I mean, I, I chose my ex.
And his new wife, she's so perfect.
You know? Everything is, is calm,
and everything is clean,
and I just I don't know how
she's doing it, because
I feel like a mess.
I, I, I can't even work as an EMT,
a job that I-I loved to do,
because I have panic attacks.
And yeah, I know, I
know I shouldn't compare
(SIGHS) But I do.
Anyway
I really, really, really
wanted a drink last night,
and I didn't have one.
Because the most important thing
is that I get to raise my kid.
Yeah, that's where I am today.
- Thank you for sharing, Val. We're glad you're here.
- (TRUCK ENGINE ROARING)
- Yeah.
- Can I offer a reflection?
- (TRUCK BACKING UP BEEPS)
- Um, can you just hold on for a second?
God! Oh shoot!
Hey! Hey! What are you
doing? That's my car!
I just go where they tell me.
No, no, no, no, no. It's a
Yes, hi this is Valentina Pearce.
Uh, case number 9-4-6-3-2.
Yeah, yeah. No, look, I know you called.
I was with my son, I
couldn't answer the phone.
Well, yeah, I can give
you a credit card now.
Actually, I'm gonna have
to put this on two cards.
Just gimme a second? Do not take my car!
You will hear that the
defendant described herself
to the police as a
long-suffering single mother,
devoted to her child.
But you will also hear evidence
of her reckless financial behavior
and her unfortunate
history of alcohol abuse.
She demanded money from the victim,
and when he refused, she snapped,
and killed him.
(THEME MUSIC)
(SOFT INTRIGUING MUSIC)
- All right, have fun pal.
- Okay. Bye, Dad.
Let's go, Oliver.
- (TREY): Don't stay long.
- (JORDAN): Yep.
You got it?
Shoot.
(EXHALES DEEPLY)
Okay.
Okay.
(WHIRRING)
(EXHALES DEEPLY)
Okay.
(DISTANT WHIRRING)
(ELECTRIC CRACKLING)
(TREY GRUNTS)
(CLATTERING)
(SIGHS)
Trey?
Trey?
Trey?
(PANTING)
- Come on.
- You're drunk!
(VAL GRUNTS)
Please, please, please.
Huh?
- Come on.
- (VAL GRUNTS)
(BREATHING HEAVILY)
(SUSPENSEFUL MUSIC)
(BREATHING HEAVILY)
(CALL RINGING)
Come on, come on, Jordan. Pick up.
(LOUD POP MUSIC)
- Jordan. Hi.
- Hey.
Uh, oh, I, I tried calling.
Oh, sorry.
Yeah, I forgot, um,
there's this school project
that Oliver's supposed to finish.
They have to do this
map of their world thing,
and it's, it's set up all
over the kitchen table,
and, and it's due tomorrow.
So, I wondered if I could
just take him with me.
- Now?
- Yeah, I mean,
it's a really important project.
It's Trey's weekend. He's
meeting us for dinner.
I actually told Trey about it, so
Oh really? Let me call Trey.
(PHONE BUZZING)
Hi, honey. Val's here
to take Oliver home,
so it'll just be us for dinner, 'kay?
Okay.
(BELL RINGING)
Okay, buddy. It's time to go.
- We just got here!
- Okay, well, we can come back,
- all right?
- You never let me do
- what I want to do!
- I do, actually.
My stuff is still at the house.
Okay, well I'm sorry, but we have to go.
Okay. I got the good honey mustard.
And chocolate milk!
We were supposed to do laser tag
after the bumper cars.
And that's why you get to watch a video!
(VIDEO PLAYING INDISTINCTLY)
(PHONE BUZZING)
(SIGHS)
Hey, what's up?
Are you somewhere you can talk?
Yeah. What's going on?
Trey's dead.
What?
I'm sorry. Maybe you should sit down.
- Okay.
- He didn't show up
at the restaurant, and he
wasn't answering his phone,
and so I came home and I
Something electrical
went wrong in the garage.
What do you mean something electrical?
I don't know. I think it was the welder.
It wasn't set up right.
I don't know, I couldn't really follow.
It shocked Trey's heart.
Jordan, I'm, I'm so sorry.
I feel so terrible
I wasn't home. I, I
Maybe I could have done something.
No, there's nothing you could have done.
Um, can I help in any way?
I'm so sorry you're
gonna have to tell Oliver.
I I hope he'll be okay.
Me, too. Um, thanks for calling.
The state would like to call
Jordan Winter as a witness,
Your Honor.
(KNOCKING ON DOOR)
(KNOCKING ON DOOR)
Ms. Pearce? I'm Detective Ross.
Oh! Hi.
I wanted to ask you a few
questions about Trey Winter.
Uh, okay. Why?
You know he was found dead?
Yeah. Uh, Jordan told
me. His wife. I'm sorry.
Is your son here?
Yeah, I have to pick him up soon.
How long will this take?
The sooner I ask the
questions, the better.
Okay. Yeah, sure. Uh, come on in.
Great.
Uh, do you want water,
coffee? Something?
No thanks.
It would be helpful if you could tell me
where you were on the day
of your ex-husband's death.
Uh, uh where I was? Why?
Uh, just take me through
your day. Can we sit?
Uh, yeah, sure.
Um, I well my kid was at his dad's.
Uh, so I did a bunch of laundry.
And then I, I cleaned my car.
Um, I need it for this new job.
It's uh, medical driving.
It's just a, it's a temporary thing.
And then, um Oh, I picked up Oliver
from this uh, bumper-car thing.
Oh um, EZone?
Yeah! Have you been there?
Yeah, I hope it's not forever
tied to this awful thing
in his mind. His dad loved cars. So
What time was that?
That you picked him up.
Oh, uh I'm not sure. Um
So, you drove directly to EZone?
You didn't go anywhere first?
Yeah, I don't remember.
I don't think so.
You know what? Take your time.
Okay. I'm sorry. It's just,
it's been a really, um,
confusing week. So
You know, um, this might help.
(OMINOUS MUSIC)
It's a neighbor's doorbell video.
Okay, uh
I mean, yes. I, I went to the house.
And when I was there, I
heard a sound from the garage,
and I, I went in, and
I found him. And
Yeah, I mean, I don't
know what I was thinking.
I, I had a panic attack.
I get those, uh, sometimes,
and I think my brain
just uh, it shut off
when I realized that he was dead.
You didn't call 911?
Well, I am 9-1-1.
I, I was an EMT, that's my training.
And you didn't report the discovery?
You just left him there?
Yeah, well that was wrong.
I was, uh, in shock. And I, um
I wanted to protect my son
from, from seeing any of it.
You know, you don't need
to keep talking to me.
And you can have a lawyer
present, if you want.
A lawyer? I mean, I didn't do anything.
Then why did you lie to me
about going into the house?
Yes, I know I shouldn't have.
But I'm telling you the truth now.
Do you have someone who
can pick up your son?
Um
(BUZZING)
Hi.
Yeah, I was, um,
hoping you could pick up
Oliver from school today.
I'm being arrested.
(BUZZING)
- Thanks.
- Yep.
Ms. Pearce, I'm Marta Bryant.
I'm the public defender
assigned to your case.
Oh, thank God. There's been
a huge misunderstanding!
Your police report says
that you didn't report
your ex's death, and
lied about breaking in?
Uh, I mean, yeah Look, I panicked.
Um, my ex-husband, he was
He was abusive, and he was cruel.
But I didn't kill him!
How did he get partial custody
of your son, if he was abusive?
Well, you know, he had
an expensive lawyer.
And he charmed the judge,
like he charmed everyone.
I spent our whole
marriage covering for him,
so there was, there was
no proof of any abuse.
(SCOFFS)
All of that could just
give you more motive.
I mean, okay, yeah, I have motive,
but I have no idea how I
could have murdered him.
I mean what? I shocked
him with a welder?
How would I even do that?
Look, I don't know what
the state will say yet,
but they have a dead body,
and they have an angry ex-wife
who broke into the house
at the time of death, and
then lied about being there.
So, it's just not a good story for you.
You could take a plea.
We could get manslaughter,
a shorter sentence.
No. I'm not gonna I'm not gonna lie
and say I killed Oliver's
dad! I'm not gonna do that.
So so you have to find
some way to get me outta here. Okay?
(BUZZING)
(CLEARS THROAT)
Uh, listen Jordan, I
know you don't like me,
but I am not a murderer.
Why were you at the house?
Okay, I, um
I went to take back the sculpture.
And when I was there, I
heard a noise in the garage,
and I found him. And
he was already gone.
I swear.
It was the worst possible
moment for you to be there.
- You know that?
- Yeah, I know.
It's like a nightmare.
How's Oliver? What did you tell him?
That you're helping the
police figure things out.
He's okay, but he knows something's up.
He's smart.
Well, thank you for taking him.
I had no one else to call.
I can't believe they're charging me.
I mean, how stupid do they think I am?
If I, if I was going to
the house to kill Trey,
I, I would've thought about cameras!
That makes sense. They
just have to look closer.
You know? Do, do what they do on TV.
Forensics. They'll find something
that proves this was an accident.
You shouldn't have been at the house.
Yeah, I know but I, I, I didn't do it.
I know you didn't.
Jordan?
- I have to go.
- Wait.
It'll be okay. I know it will.
Jordan, just hold on.
Can you please just
(DOOR CLOSING)
(EXHALES DEEPLY)
(BUZZING)
(TENSE MUSIC)
(VAL): I-I was so stupid not to see it!
Jordan is the only one
who thinks I didn't do it
because she knows that I'm innocent!
Because she killed him!
- Based on what?
- Well, she practically
- just admitted it to me.
- That she killed him?
Well, no, but you know I, I could tell.
I could, I could see it in her eyes.
There's no evidence
that points to Jordan.
There's, there's nothing. And the police
looked at the wife. They always do.
Look if you would have been in the room,
you would've seen it, too.
Okay? And then she just, she ran.
Okay. The only thing to
do right now is to focus
on your defense, that
you tried to revive him
after an accident, and make
you appealing to a jury.
Isn't finding the real killer
gonna make me a lot more appealing?
No. It won't serve
you to point at Jordan
with no evidence. Trust me,
it will only make you seem
remorseless and vindictive.
I can't have remorse for
something I didn't do!
Have you ever known the
defendant to seem unstable?
I mean, she's a single mom. It's a lot.
Did you send an email to your husband
describing the defendant as, quote
"Scarily unhinged"?
If I did, I was exaggerating.
The two of them shared a child,
sometimes there were frustrations.
Did you go on to say,
"I never know what
she's going to do next"?
I guess I did.
(TENSE MUSIC)
Can you verify that this
is your husband, Mr. Winter?
Yes.
These photographs were from
your social media accounts,
and your husband's. Was this a vacation?
Yeah. Sorry
I've never been in court before,
I didn't know what this would be like.
I don't think Val did anything.
No, no. That's not the
purpose of this exhibit.
We're just trying to give the jury
a sense of who Trey was,
and of the life that was lost,
since he can't be with us right now.
Could you tell us the story of
how you and your husband met?
Um, we met at a 40th birthday party
that I planned. I'm an event planner.
Trey was a guest. He was
telling funny stories.
So, people enjoyed
themselves around Trey?
- Yes.
- Is this Trey's son, Oliver?
- Yes.
- Were Trey and his son close?
Fairly close.
(CHUCKLING)
Did he enjoy this party?
Yeah. Trey liked to give gifts.
And is this a fishing trip with Trey?
Yeah.
So, they would have
shared that bond, right?
As Oliver got older?
Mm-hmm.
I'm trying to paint a picture
of your husband for the jury.
So they can see who we lost.
You have.
Thank you, Mrs. Winter.
I know that this is
very difficult for you.
No further questions.
Uh, just one moment, please?
(INDISTINCT WHISPERING)
Uh, can we go back a few
photos in the exhibit, please?
Thanks. Hi, Mrs. Winter.
Uh, this photo was taken at
Olivers last birthday party.
- Is that correct?
- Yes.
And would you mind sharing
with us when his birthday is?
It, it was August 14th.
August 14th. Okay.
We had a hot August, if you'll remember.
It must have been pretty
uncomfortable for you
wearing a long-sleeved
sweater in August.
- I don't remember.
- Well, you can see
Trey and Oliver, they're
both wearing shorts,
and then you're in a turtle
neck sweater. I'm just curious
if there's a reason why
you're dressed so warmly.
Objection. Why is this relevant?
Get to the point, counsellor.
I'll try to be as clear
as possible, Mrs. Winter.
Can you talk to me about
choosing your outfit
for Oliver's last birthday
party on August 14th?
I don't remember. I'm, I'm
I don't feel very
well. Can I be excused?
Please answer the question
as well as you can.
It's a simple question, Mrs. Winter.
You're still not answering
me. All you have to do
is tell the truth. Was the sweater
maybe hiding something?
Okay, I'm gonna remind
you, you're under oath.
Can you please just tell us why,
at a hot summer event, when
everyone else around you
is wearing shorts,
that you chose to wear
a turtleneck sweater?
Because I had bruises.
(PEOPLE MURMURING)
Can you speak up, please?
I had bruises on my neck and my arms.
And what caused the bruises?
(CRYING)
Trey.
Trey, my late husband.
And that's why you killed him, isn't it?
You wanted it to seem like an accident,
but then Ms. Pearce walked
in and made everything
more complicated, isn't that right?
But you didn't mean for
Val to take the blame.
I mean, did you? Did you mean
for all of this to happen?
No. I didn't want this to happen!
Your Honor, I would
like to be heard outside
the presence of the jury, please.
Will the bailiff please escort
the jury to the jury room?
(INDISTINCT WHISPERING)
Your Honor, this witness
has a right to counsel.
She has 5th Amendment rights here.
Do you understand that you have a right,
under the 5th Amendment,
not to incriminate yourself in court?
- Yes.
- She should have counsel,
judge.
I can arrange for an
attorney to advise you.
We can recess until that happens.
No. No. I want to keep going.
I don't want to wait.
I don't wanna keep this in anymore.
I have to object.
You called her, counsellor.
The defense will be allowed
this line of inquiry.
You've told us about previous times
that your husband was violent.
Can you talk to us about what
happened the day of his death?
Trey and I had an argument
that morning before Oliver woke up.
Can you tell us what you argued about?
Val needed money. She
wanted this little sculpture
and I, I told Trey to give it to her.
I thought that we should be generous.
He said the conversation was over,
but I kept pressing him.
And then he got enraged.
He was obsessed with the
fact that Val had left him.
He couldn't get over it.
He said he'd never be
humiliated like that again,
and if I ever left, he'd kill me.
I told him I was leaving, and
I was going to take Oliver,
and then he grabbed me
And then he started choking me.
And then I blacked out.
I don't remember for how long.
But when I woke up,
Trey wanted to have sex.
Just to show that he could control me.
I'm sorry this is the first
time I'm saying this out loud.
No, it's okay. You're doing good.
Can you walk me through
what happened next?
Trey took a shower.
It felt like I was sleepwalking.
I don't remember making
the decision. I just
I knew in my body what I had to do.
(OMINOUS MUSIC)
I turned off the breaker for his welder.
And then I switched the
cables for the live end
and the ground end.
I put the ground on the steel table.
And then I spilled
some water on the floor.
(MARTA): How did you
know how to do all that?
Trey loved working on cars.
He taught me about the things
he cared about the most.
It was the best part
of our relationship.
I turned on the machine
and I switched the breaker
when Oliver and I left.
And that meant that the
welder would shock him?
The table would.
I didn't know if, if he would touch it.
Or if he would notice
that something was wrong,
and he would fix it.
Trey was angry enough
that he was distracted,
and it might look like a
mistake he made himself.
I told myself that it
was up to the universe.
If Trey was supposed to
go, then it would work.
But it wasn't the
universe. And it wasn't Val.
(VOICE BREAKING): I did it.
And just to be clear,
you never talked to Ms.
Pearce about any of this?
No. Val when you got arrested,
I thought that they would
see that it was a mistake,
and it would all go away. But it hasn't.
Trey hid everything bad he ever did.
I don't want to be like him.
I can finally breathe again,
now that I've said this.
I'm sorry I let it go this far.
Thank you, Jordan, for your honesty.
I have no further questions, Your Honor.
No redirect. May we approach?
Yes.
The witness may step down.
(INDISTINCT WHISPERING)
I'd like to request a recess.
The state has some decisions to make
about the viability of this case.
Yes, I think you do.
Can we talk, Mrs. Winter?
We were talking about
forgiveness last week.
I wanted to return to that.
I think forgiveness is a naturally
occurring phenomenon. It
unfolds, or it doesn't.
You can have compassion. But
you don't decide to forgiv.
And I don't think it happens
unless you let yourself
feel your anger and sadness.
That's part of the process.
(DOORBELL RINGING)
Oh. hi.
(SIGHS)
You're baking, out on bail?
I don't know, I just,
I had to do something,
and so I started making scones.
Well, can I come in?
I mean, you know I'm
not going to murder you.
You can have it. I was
going to send it to you.
I don't want it.
- How's Oliver?
- He's okay. Considering.
- Did you tell him what I did?
- No. No.
Thanks.
He said that you told him
his dad would always be in his heart.
Which is, uh
(SIGHS)
You know, his dad
didn't know how to love,
and Oliver does.
And I don't want him to lose that.
And so, I'm trying to figure
out what to do about you.
(SOFT MUSIC) Because he loves you.
How did you make it seem
like everything was fine?
How did you do that when you were
you were going through
the same thing that I did?
I wanted it to be true.
I was so afraid.
And I didn't say this on the stand,
in case Oliver might
find out later on, but
I was afraid for Oliver, too.
- Did Trey hurt him?
- No.
But I could see it coming.
Trey was getting worse.
And he wanted to punish you
so badly.
I kept thinking that
switch would go off in him,
and
that he would kill all of us.
Then why didn't you tell me?
Because I thought saying it
out loud might make it real.
You, you made me feel insane.
Like, like this was all my problem.
- I know.
- You let me
put Oliver in danger.
But that's why I did what I did!
(SIGHS)
You know, the jury is never,
they're never going to
believe this was self-defence.
I know.
My lawyer says that
choking causes brain damage,
so we could argue that I'm deranged.
Which maybe, I am. I
mean, I'm a murderer.
And I let them take you away from Oliver
when I knew that you'd done nothing.
I don't know who I am anymore,
that I let that happen.
Well, I know you didn't have
to tell the truth on the stand.
I did, though.
I had it in my head that I'd been hurt,
so I needed to save myself.
But
it was killing me.
Oliver, he, uh, he misses you.
I miss him, too.
That's pretty good.
Where's the green pencil?
Hm? Um, it's right here, buddy.
No, the light green. It was here.
Yeah, I don't know, honey.
(PENCILS CLATTERING)
Oliver!
See, you had it!
(SIGHS)
What are you drawing?
It-it's two ninjas
escaping from a tower.
Oh! Cool. Do they have superpowers?
Kind of. Like, they're so fast
and quiet they seem invisible.
- Oh, got it.
- And they protect each other.
Like, one can jump super high
to see if they're being chased.
Another one is immune to poison,
so he can drink anything.
Well, when you're done,
can I put it on the fridge?
I wish I could give it to Jordan.
(UNSETTLING MUSIC)
You know what, buddy?
It's getting kinda late.
Why don't you go brush your teeth, okay?
- Okay.
- Okay.
Hey, Marta. It's Val.
Um, listen, can you meet me tomorrow?
I wanted to talk to you about something.
(INDISTINCT CHATTER)
Okay, as your attorney, I'm
begging you not to do this.
But I am right.
You're technically right,
yes, but it's, it's a risk.
I've been reading about this, okay?
Men get acquitted for
self-defence all the time,
but women have to protect themselves
in a way that won't get them killed.
Yes, I know. But
the law doesn't make you invincible.
I don't know, it kind of does.
Okay. Okay. Wait here.
I'll I'll get him.
for 24 hours. At
that point we bring him
- Patrick.
- Hey.
Hey. Uh, do you have a minute?
My client would like a word.
- See ya back at the office.
- Yeah.
I thought I wouldn't
have to see you again
and be reminded of having
- my ass handed to me in court.
- (CHUCKLING)
Uh, well, I was just
I was thinking about
some of the difficulties
you might be having, um,
with the case against Jordan.
- Oh, you were?
- Yeah, so, um,
Jordan's testimony
injected reasonable doubt
into the case against me,
so you dropped it. Right?
- Right.
- Right. So, I was thinking,
what if Jordan's lawyer
brought in a witness,
who, who knew something
of Trey's violence and
his skill at hiding it?
- Go on.
- And that person
could break down on the stand
and confess to the murder.
(CHUCKLING)
And why would someone do that?
Well, they could do it
for any reason, really.
But if that someone were
already tried for the crime,
you, you couldn't go after them, right?
Because that's called, um
- double jeopardy. Right?
- Mm-hmm.
You can't be tried
twice for the same thing.
Are you threatening to do that?
She's just talking about
all the remote possibilities.
- Mm-hmm.
- Are you saying you killed him?
Oh, I didn't kill anyone.
Are you talking about perjury, then?
Because I could hand this
case off to a colleague,
and make myself a witness,
and testify about this conversation.
- He could?
- My clients talking
purely in hypotheticals.
This is not a hypothetical.
There's only one
person that's been tried
for this crime and can't be tried again.
She's just saying that if
something like that happened,
it could create a lot
of confusion for a jury.
Mm-hmm. And there might be
better cases to prosecute
with more deserving victims.
You don't get to decide who's deserving.
No, but you do.
Is this double-jeopardy
thing your idea?
Did you put her up to this?
No, no. I strongly
advised her against it.
Mm-hmm.
But you know she's right.
Oh, I feel so much
better having told you!
It's been keeping me
up at night. Thank you.
Good luck with your decision.
Shall we?
That's a good one.
Oi!
- Hi!
- Jordan!
Hi, Oliver. I missed you.
Can you show me some soccer tricks?
Yeah, sure.
- Hi.
- Hey.
- They dropped the case.
- Yeah.
I don't know how to thank you.
Well, just be there for Oliver.
Oh, you're stuck with me.
Here. You should have this.
You don't have to keep
it, but it's yours.
Oh.
- Thank you.
- Can I see that?
Yeah, just be careful.
My friend made it.
- You made this?
- I wish!
No, it was a friend
from a long time ago.
And besides, Jordan isn't a friend.
She's family.
Yeah.
- Wanna walk?
- Yeah.
(SOFT MUSIC)
(THEME MUSIC)
Calm and contrite.
Can you say that and breathe, too?
We need you to appeal to the jury.
Is she testifying for me?
The state's bringing her.
She's testifying against me?
We have to keep movin'.
(TENSE MUSIC)
You have to help me, Jordan.
Val, we can't talk to her.
(MAN): Your First Aid and CPR
certifications are current?
Yeah. Just renewed.
Mm-hmm. You were a paramedic?
An EMT. I, I loved it.
Um, being calm in an emergency.
Yup, I love helping people,
you know, all of that.
Yeah. Can I ask why you're not
looking for an EMT position now?
Uh, ambulance hours are long,
and I have primary custody of, um
Yeah, so I, I need something flexible.
Okay. Um
I'm seeing a long gap
here with no employment.
Right. So, I um, I stopped
working when I had a baby.
My ex-husband, uh,
thought it would be best.
- Okay.
- I'm a really hard worker.
You're overqualified to
just be driving patients
to medical appointments.
Yeah, I know. Um
I just, uh, my
My alimony has run out, and
I could really use this job.
(SIGHS)
Do you have your own car?
Yes, I do! The car's not overqualified.
(LAUGHING)
I mean, it's not fancy.
Uh, but it is reliable. Uh, like me.
Okay. Uh, thank you for coming in.
- We'll get in touch.
- Oh, thank you.
- Yeah.
- Thank you so much.
And thank you for letting
me bring in Oliver.
You're welcome.
- Buddy, can you say thanks?
- Thank you.
Whatcha drawing there, Oliver?
It's a "Destroy Anything
in Its Path" Robot.
These are all things it's destroying.
Oh! Yeah.
Okay buddy, let's get
you to your dad's, okay?
Did you get the job?
Well, fingers crossed! Let's go.
Jason's dad is moving
out of their house.
Why do you have to
move, and Dad lives here?
Uh, well, that's just the
way the judge decided things.
And besides, I like our
little place. Don't you?
I guess.
So, uh, your dad is gonna drop you off
- on Sunday night, okay?
- Okay.
And you can call me, for any reason.
- All right? No matter what.
- (PHONE BUZZING)
Oh, not now, predatory lender.
Who's Preta Torilender?
(CHUCKLING)
Um
It's like if you borrowed a candy bar
from that destroying robot,
and it wanted five back.
- Oh.
- Yeah. But it's fine.
I'm, I am fine! No robot
is gonna destroy me.
All right, you got a
stuffie and a toothbrush?
I have like a million
stuffies from Jordan.
Right. Of course you do.
I know you don't like
Jordan, but she's nice.
No, I no, I-I do, I do like her.
I do. And, and what matters
is that you like her.
- Yeah.
- Okay.
Oh wait. Wait, wait, hold on, buddy.
We have to ring the doorbell, okay?
- It's my house.
- Yeah, I know.
Just stay with me. Okay?
Ha! Hi, Ollie!
Hi, Jordan.
Oliver is ready for his weekend.
Oliver. I missed you.
I think, uh, I think
he's got everything.
We have everything he needs here!
So, I hear.
Hey, I need you to sign this waiver.
We're going to an
E-games place on Sunday.
- Cool!
- Why does it need a waiver?
I don't know. It's just bumper cars
and laser tag. I'm sure it's safe.
Okay, you need to tell me ahead of time
about these kinds of things.
It just came up. I'm
looking at it for an event.
Yeah, okay, well still, we
should've had a conversation.
C'mon, Mom. Just sign it!
Okay. Signed.
- Thank you.
- Mm-hmm. Okay, I love you.
- Love you too.
- Have fun.
Hey, there's a present
waiting for you upstairs
in your bedroom. Go on.
Uh, listen I needed to talk
to Trey about that sculpture.
- Okay. He's in the garage.
- What kinda mood is he in?
His moods fine, Val. It's always fine.
I didn't make up what he was like.
- I just
- I didn't.
- Okay.
- Okay.
(DISTANT WHIRRING)
(WHIRRING)
Trey. Trey.
I need to talk to you.
So, I'm, I'm a little
behind on my car payments,
and I need my car for this new job,
so I wondered if I could have this back.
Why?
Well, Annie's really having a moment,
and her pieces are selling
for a lot of money online.
I don't want to sell it.
You never even liked it.
We're not selling it.
Trey, she was my friend.
I should've put it on
the list I gave the judge.
Yeah, well, you didn't,
and it was a wedding present
to the both of us, so
I was very agitated at the time.
Look at yourself, you're pathetic!
No kidding.
Okay, I I'll split it with you,
the money. 50-50, okay?
I just, I need a car. I need
to take Oliver to school,
and, and to pick him up.
And what are you doing
with the child support?
Paying rent. I'm feeding
and clothing our son.
Look, Val, if this is all just too hard,
Jordan and I can just take custody.
You can't have him.
Well, he could use some stability.
Look, Val, let's just be honest, okay?
You lost your last job, you
can't hold down your new one
and you are one mess-up away
from being a drunk again.
I'm only like this because of you.
Because of because
of what you did to me.
(CHUCKLING)
No. No, no, no.
(GRUNTING)
You were crazy when we met.
Which at the time, was
kind of hot. But now?
So, I'll just take this.
(TENSE MUSIC)
It's mine!
- Take it from me.
- Mom!
Look at my new toy.
It's cool bud. I'll see you Sunday.
(KISSES)
(QUIETLY SOBS)
I don't know.
(BREATHING HEAVILY)
(PHONE BUZZING)
Argh!
Okay. Okay.
(LIGHT MUSIC)
Oh. I get it.
That blabbermouth Junior
filed a complaint
'cause I pushed him around.
I'll get you a punching
bag for Christmas.
and we'll be adding
the Tuesday night group,
that people have been asking for.
And now, I'll open it up.
Uh, yeah, I'll go.
Uh, yeah, I'm really
struggling this weekend.
Val, uh, you're on mute.
Oh sorry. Uh here we go.
Yeah, I-I said I'm, I'm struggling.
Uh, my kid is at his
dad's this weekend, and
I just, I hate dropping him off there.
I worry.
He drew this, uh, this picture
of a "Destroy Anything
in Its Path Robot,"
and I thought, "Oh, it's your dad!
Looks just like him!"
And then I thought, I don't know, maybe,
maybe I'm the destroy everything robot.
I mean, I, I chose my ex.
And his new wife, she's so perfect.
You know? Everything is, is calm,
and everything is clean,
and I just I don't know how
she's doing it, because
I feel like a mess.
I, I, I can't even work as an EMT,
a job that I-I loved to do,
because I have panic attacks.
And yeah, I know, I
know I shouldn't compare
(SIGHS) But I do.
Anyway
I really, really, really
wanted a drink last night,
and I didn't have one.
Because the most important thing
is that I get to raise my kid.
Yeah, that's where I am today.
- Thank you for sharing, Val. We're glad you're here.
- (TRUCK ENGINE ROARING)
- Yeah.
- Can I offer a reflection?
- (TRUCK BACKING UP BEEPS)
- Um, can you just hold on for a second?
God! Oh shoot!
Hey! Hey! What are you
doing? That's my car!
I just go where they tell me.
No, no, no, no, no. It's a
Yes, hi this is Valentina Pearce.
Uh, case number 9-4-6-3-2.
Yeah, yeah. No, look, I know you called.
I was with my son, I
couldn't answer the phone.
Well, yeah, I can give
you a credit card now.
Actually, I'm gonna have
to put this on two cards.
Just gimme a second? Do not take my car!
You will hear that the
defendant described herself
to the police as a
long-suffering single mother,
devoted to her child.
But you will also hear evidence
of her reckless financial behavior
and her unfortunate
history of alcohol abuse.
She demanded money from the victim,
and when he refused, she snapped,
and killed him.
(THEME MUSIC)
(SOFT INTRIGUING MUSIC)
- All right, have fun pal.
- Okay. Bye, Dad.
Let's go, Oliver.
- (TREY): Don't stay long.
- (JORDAN): Yep.
You got it?
Shoot.
(EXHALES DEEPLY)
Okay.
Okay.
(WHIRRING)
(EXHALES DEEPLY)
Okay.
(DISTANT WHIRRING)
(ELECTRIC CRACKLING)
(TREY GRUNTS)
(CLATTERING)
(SIGHS)
Trey?
Trey?
Trey?
(PANTING)
- Come on.
- You're drunk!
(VAL GRUNTS)
Please, please, please.
Huh?
- Come on.
- (VAL GRUNTS)
(BREATHING HEAVILY)
(SUSPENSEFUL MUSIC)
(BREATHING HEAVILY)
(CALL RINGING)
Come on, come on, Jordan. Pick up.
(LOUD POP MUSIC)
- Jordan. Hi.
- Hey.
Uh, oh, I, I tried calling.
Oh, sorry.
Yeah, I forgot, um,
there's this school project
that Oliver's supposed to finish.
They have to do this
map of their world thing,
and it's, it's set up all
over the kitchen table,
and, and it's due tomorrow.
So, I wondered if I could
just take him with me.
- Now?
- Yeah, I mean,
it's a really important project.
It's Trey's weekend. He's
meeting us for dinner.
I actually told Trey about it, so
Oh really? Let me call Trey.
(PHONE BUZZING)
Hi, honey. Val's here
to take Oliver home,
so it'll just be us for dinner, 'kay?
Okay.
(BELL RINGING)
Okay, buddy. It's time to go.
- We just got here!
- Okay, well, we can come back,
- all right?
- You never let me do
- what I want to do!
- I do, actually.
My stuff is still at the house.
Okay, well I'm sorry, but we have to go.
Okay. I got the good honey mustard.
And chocolate milk!
We were supposed to do laser tag
after the bumper cars.
And that's why you get to watch a video!
(VIDEO PLAYING INDISTINCTLY)
(PHONE BUZZING)
(SIGHS)
Hey, what's up?
Are you somewhere you can talk?
Yeah. What's going on?
Trey's dead.
What?
I'm sorry. Maybe you should sit down.
- Okay.
- He didn't show up
at the restaurant, and he
wasn't answering his phone,
and so I came home and I
Something electrical
went wrong in the garage.
What do you mean something electrical?
I don't know. I think it was the welder.
It wasn't set up right.
I don't know, I couldn't really follow.
It shocked Trey's heart.
Jordan, I'm, I'm so sorry.
I feel so terrible
I wasn't home. I, I
Maybe I could have done something.
No, there's nothing you could have done.
Um, can I help in any way?
I'm so sorry you're
gonna have to tell Oliver.
I I hope he'll be okay.
Me, too. Um, thanks for calling.
The state would like to call
Jordan Winter as a witness,
Your Honor.
(KNOCKING ON DOOR)
(KNOCKING ON DOOR)
Ms. Pearce? I'm Detective Ross.
Oh! Hi.
I wanted to ask you a few
questions about Trey Winter.
Uh, okay. Why?
You know he was found dead?
Yeah. Uh, Jordan told
me. His wife. I'm sorry.
Is your son here?
Yeah, I have to pick him up soon.
How long will this take?
The sooner I ask the
questions, the better.
Okay. Yeah, sure. Uh, come on in.
Great.
Uh, do you want water,
coffee? Something?
No thanks.
It would be helpful if you could tell me
where you were on the day
of your ex-husband's death.
Uh, uh where I was? Why?
Uh, just take me through
your day. Can we sit?
Uh, yeah, sure.
Um, I well my kid was at his dad's.
Uh, so I did a bunch of laundry.
And then I, I cleaned my car.
Um, I need it for this new job.
It's uh, medical driving.
It's just a, it's a temporary thing.
And then, um Oh, I picked up Oliver
from this uh, bumper-car thing.
Oh um, EZone?
Yeah! Have you been there?
Yeah, I hope it's not forever
tied to this awful thing
in his mind. His dad loved cars. So
What time was that?
That you picked him up.
Oh, uh I'm not sure. Um
So, you drove directly to EZone?
You didn't go anywhere first?
Yeah, I don't remember.
I don't think so.
You know what? Take your time.
Okay. I'm sorry. It's just,
it's been a really, um,
confusing week. So
You know, um, this might help.
(OMINOUS MUSIC)
It's a neighbor's doorbell video.
Okay, uh
I mean, yes. I, I went to the house.
And when I was there, I
heard a sound from the garage,
and I, I went in, and
I found him. And
Yeah, I mean, I don't
know what I was thinking.
I, I had a panic attack.
I get those, uh, sometimes,
and I think my brain
just uh, it shut off
when I realized that he was dead.
You didn't call 911?
Well, I am 9-1-1.
I, I was an EMT, that's my training.
And you didn't report the discovery?
You just left him there?
Yeah, well that was wrong.
I was, uh, in shock. And I, um
I wanted to protect my son
from, from seeing any of it.
You know, you don't need
to keep talking to me.
And you can have a lawyer
present, if you want.
A lawyer? I mean, I didn't do anything.
Then why did you lie to me
about going into the house?
Yes, I know I shouldn't have.
But I'm telling you the truth now.
Do you have someone who
can pick up your son?
Um
(BUZZING)
Hi.
Yeah, I was, um,
hoping you could pick up
Oliver from school today.
I'm being arrested.
(BUZZING)
- Thanks.
- Yep.
Ms. Pearce, I'm Marta Bryant.
I'm the public defender
assigned to your case.
Oh, thank God. There's been
a huge misunderstanding!
Your police report says
that you didn't report
your ex's death, and
lied about breaking in?
Uh, I mean, yeah Look, I panicked.
Um, my ex-husband, he was
He was abusive, and he was cruel.
But I didn't kill him!
How did he get partial custody
of your son, if he was abusive?
Well, you know, he had
an expensive lawyer.
And he charmed the judge,
like he charmed everyone.
I spent our whole
marriage covering for him,
so there was, there was
no proof of any abuse.
(SCOFFS)
All of that could just
give you more motive.
I mean, okay, yeah, I have motive,
but I have no idea how I
could have murdered him.
I mean what? I shocked
him with a welder?
How would I even do that?
Look, I don't know what
the state will say yet,
but they have a dead body,
and they have an angry ex-wife
who broke into the house
at the time of death, and
then lied about being there.
So, it's just not a good story for you.
You could take a plea.
We could get manslaughter,
a shorter sentence.
No. I'm not gonna I'm not gonna lie
and say I killed Oliver's
dad! I'm not gonna do that.
So so you have to find
some way to get me outta here. Okay?
(BUZZING)
(CLEARS THROAT)
Uh, listen Jordan, I
know you don't like me,
but I am not a murderer.
Why were you at the house?
Okay, I, um
I went to take back the sculpture.
And when I was there, I
heard a noise in the garage,
and I found him. And
he was already gone.
I swear.
It was the worst possible
moment for you to be there.
- You know that?
- Yeah, I know.
It's like a nightmare.
How's Oliver? What did you tell him?
That you're helping the
police figure things out.
He's okay, but he knows something's up.
He's smart.
Well, thank you for taking him.
I had no one else to call.
I can't believe they're charging me.
I mean, how stupid do they think I am?
If I, if I was going to
the house to kill Trey,
I, I would've thought about cameras!
That makes sense. They
just have to look closer.
You know? Do, do what they do on TV.
Forensics. They'll find something
that proves this was an accident.
You shouldn't have been at the house.
Yeah, I know but I, I, I didn't do it.
I know you didn't.
Jordan?
- I have to go.
- Wait.
It'll be okay. I know it will.
Jordan, just hold on.
Can you please just
(DOOR CLOSING)
(EXHALES DEEPLY)
(BUZZING)
(TENSE MUSIC)
(VAL): I-I was so stupid not to see it!
Jordan is the only one
who thinks I didn't do it
because she knows that I'm innocent!
Because she killed him!
- Based on what?
- Well, she practically
- just admitted it to me.
- That she killed him?
Well, no, but you know I, I could tell.
I could, I could see it in her eyes.
There's no evidence
that points to Jordan.
There's, there's nothing. And the police
looked at the wife. They always do.
Look if you would have been in the room,
you would've seen it, too.
Okay? And then she just, she ran.
Okay. The only thing to
do right now is to focus
on your defense, that
you tried to revive him
after an accident, and make
you appealing to a jury.
Isn't finding the real killer
gonna make me a lot more appealing?
No. It won't serve
you to point at Jordan
with no evidence. Trust me,
it will only make you seem
remorseless and vindictive.
I can't have remorse for
something I didn't do!
Have you ever known the
defendant to seem unstable?
I mean, she's a single mom. It's a lot.
Did you send an email to your husband
describing the defendant as, quote
"Scarily unhinged"?
If I did, I was exaggerating.
The two of them shared a child,
sometimes there were frustrations.
Did you go on to say,
"I never know what
she's going to do next"?
I guess I did.
(TENSE MUSIC)
Can you verify that this
is your husband, Mr. Winter?
Yes.
These photographs were from
your social media accounts,
and your husband's. Was this a vacation?
Yeah. Sorry
I've never been in court before,
I didn't know what this would be like.
I don't think Val did anything.
No, no. That's not the
purpose of this exhibit.
We're just trying to give the jury
a sense of who Trey was,
and of the life that was lost,
since he can't be with us right now.
Could you tell us the story of
how you and your husband met?
Um, we met at a 40th birthday party
that I planned. I'm an event planner.
Trey was a guest. He was
telling funny stories.
So, people enjoyed
themselves around Trey?
- Yes.
- Is this Trey's son, Oliver?
- Yes.
- Were Trey and his son close?
Fairly close.
(CHUCKLING)
Did he enjoy this party?
Yeah. Trey liked to give gifts.
And is this a fishing trip with Trey?
Yeah.
So, they would have
shared that bond, right?
As Oliver got older?
Mm-hmm.
I'm trying to paint a picture
of your husband for the jury.
So they can see who we lost.
You have.
Thank you, Mrs. Winter.
I know that this is
very difficult for you.
No further questions.
Uh, just one moment, please?
(INDISTINCT WHISPERING)
Uh, can we go back a few
photos in the exhibit, please?
Thanks. Hi, Mrs. Winter.
Uh, this photo was taken at
Olivers last birthday party.
- Is that correct?
- Yes.
And would you mind sharing
with us when his birthday is?
It, it was August 14th.
August 14th. Okay.
We had a hot August, if you'll remember.
It must have been pretty
uncomfortable for you
wearing a long-sleeved
sweater in August.
- I don't remember.
- Well, you can see
Trey and Oliver, they're
both wearing shorts,
and then you're in a turtle
neck sweater. I'm just curious
if there's a reason why
you're dressed so warmly.
Objection. Why is this relevant?
Get to the point, counsellor.
I'll try to be as clear
as possible, Mrs. Winter.
Can you talk to me about
choosing your outfit
for Oliver's last birthday
party on August 14th?
I don't remember. I'm, I'm
I don't feel very
well. Can I be excused?
Please answer the question
as well as you can.
It's a simple question, Mrs. Winter.
You're still not answering
me. All you have to do
is tell the truth. Was the sweater
maybe hiding something?
Okay, I'm gonna remind
you, you're under oath.
Can you please just tell us why,
at a hot summer event, when
everyone else around you
is wearing shorts,
that you chose to wear
a turtleneck sweater?
Because I had bruises.
(PEOPLE MURMURING)
Can you speak up, please?
I had bruises on my neck and my arms.
And what caused the bruises?
(CRYING)
Trey.
Trey, my late husband.
And that's why you killed him, isn't it?
You wanted it to seem like an accident,
but then Ms. Pearce walked
in and made everything
more complicated, isn't that right?
But you didn't mean for
Val to take the blame.
I mean, did you? Did you mean
for all of this to happen?
No. I didn't want this to happen!
Your Honor, I would
like to be heard outside
the presence of the jury, please.
Will the bailiff please escort
the jury to the jury room?
(INDISTINCT WHISPERING)
Your Honor, this witness
has a right to counsel.
She has 5th Amendment rights here.
Do you understand that you have a right,
under the 5th Amendment,
not to incriminate yourself in court?
- Yes.
- She should have counsel,
judge.
I can arrange for an
attorney to advise you.
We can recess until that happens.
No. No. I want to keep going.
I don't want to wait.
I don't wanna keep this in anymore.
I have to object.
You called her, counsellor.
The defense will be allowed
this line of inquiry.
You've told us about previous times
that your husband was violent.
Can you talk to us about what
happened the day of his death?
Trey and I had an argument
that morning before Oliver woke up.
Can you tell us what you argued about?
Val needed money. She
wanted this little sculpture
and I, I told Trey to give it to her.
I thought that we should be generous.
He said the conversation was over,
but I kept pressing him.
And then he got enraged.
He was obsessed with the
fact that Val had left him.
He couldn't get over it.
He said he'd never be
humiliated like that again,
and if I ever left, he'd kill me.
I told him I was leaving, and
I was going to take Oliver,
and then he grabbed me
And then he started choking me.
And then I blacked out.
I don't remember for how long.
But when I woke up,
Trey wanted to have sex.
Just to show that he could control me.
I'm sorry this is the first
time I'm saying this out loud.
No, it's okay. You're doing good.
Can you walk me through
what happened next?
Trey took a shower.
It felt like I was sleepwalking.
I don't remember making
the decision. I just
I knew in my body what I had to do.
(OMINOUS MUSIC)
I turned off the breaker for his welder.
And then I switched the
cables for the live end
and the ground end.
I put the ground on the steel table.
And then I spilled
some water on the floor.
(MARTA): How did you
know how to do all that?
Trey loved working on cars.
He taught me about the things
he cared about the most.
It was the best part
of our relationship.
I turned on the machine
and I switched the breaker
when Oliver and I left.
And that meant that the
welder would shock him?
The table would.
I didn't know if, if he would touch it.
Or if he would notice
that something was wrong,
and he would fix it.
Trey was angry enough
that he was distracted,
and it might look like a
mistake he made himself.
I told myself that it
was up to the universe.
If Trey was supposed to
go, then it would work.
But it wasn't the
universe. And it wasn't Val.
(VOICE BREAKING): I did it.
And just to be clear,
you never talked to Ms.
Pearce about any of this?
No. Val when you got arrested,
I thought that they would
see that it was a mistake,
and it would all go away. But it hasn't.
Trey hid everything bad he ever did.
I don't want to be like him.
I can finally breathe again,
now that I've said this.
I'm sorry I let it go this far.
Thank you, Jordan, for your honesty.
I have no further questions, Your Honor.
No redirect. May we approach?
Yes.
The witness may step down.
(INDISTINCT WHISPERING)
I'd like to request a recess.
The state has some decisions to make
about the viability of this case.
Yes, I think you do.
Can we talk, Mrs. Winter?
We were talking about
forgiveness last week.
I wanted to return to that.
I think forgiveness is a naturally
occurring phenomenon. It
unfolds, or it doesn't.
You can have compassion. But
you don't decide to forgiv.
And I don't think it happens
unless you let yourself
feel your anger and sadness.
That's part of the process.
(DOORBELL RINGING)
Oh. hi.
(SIGHS)
You're baking, out on bail?
I don't know, I just,
I had to do something,
and so I started making scones.
Well, can I come in?
I mean, you know I'm
not going to murder you.
You can have it. I was
going to send it to you.
I don't want it.
- How's Oliver?
- He's okay. Considering.
- Did you tell him what I did?
- No. No.
Thanks.
He said that you told him
his dad would always be in his heart.
Which is, uh
(SIGHS)
You know, his dad
didn't know how to love,
and Oliver does.
And I don't want him to lose that.
And so, I'm trying to figure
out what to do about you.
(SOFT MUSIC) Because he loves you.
How did you make it seem
like everything was fine?
How did you do that when you were
you were going through
the same thing that I did?
I wanted it to be true.
I was so afraid.
And I didn't say this on the stand,
in case Oliver might
find out later on, but
I was afraid for Oliver, too.
- Did Trey hurt him?
- No.
But I could see it coming.
Trey was getting worse.
And he wanted to punish you
so badly.
I kept thinking that
switch would go off in him,
and
that he would kill all of us.
Then why didn't you tell me?
Because I thought saying it
out loud might make it real.
You, you made me feel insane.
Like, like this was all my problem.
- I know.
- You let me
put Oliver in danger.
But that's why I did what I did!
(SIGHS)
You know, the jury is never,
they're never going to
believe this was self-defence.
I know.
My lawyer says that
choking causes brain damage,
so we could argue that I'm deranged.
Which maybe, I am. I
mean, I'm a murderer.
And I let them take you away from Oliver
when I knew that you'd done nothing.
I don't know who I am anymore,
that I let that happen.
Well, I know you didn't have
to tell the truth on the stand.
I did, though.
I had it in my head that I'd been hurt,
so I needed to save myself.
But
it was killing me.
Oliver, he, uh, he misses you.
I miss him, too.
That's pretty good.
Where's the green pencil?
Hm? Um, it's right here, buddy.
No, the light green. It was here.
Yeah, I don't know, honey.
(PENCILS CLATTERING)
Oliver!
See, you had it!
(SIGHS)
What are you drawing?
It-it's two ninjas
escaping from a tower.
Oh! Cool. Do they have superpowers?
Kind of. Like, they're so fast
and quiet they seem invisible.
- Oh, got it.
- And they protect each other.
Like, one can jump super high
to see if they're being chased.
Another one is immune to poison,
so he can drink anything.
Well, when you're done,
can I put it on the fridge?
I wish I could give it to Jordan.
(UNSETTLING MUSIC)
You know what, buddy?
It's getting kinda late.
Why don't you go brush your teeth, okay?
- Okay.
- Okay.
Hey, Marta. It's Val.
Um, listen, can you meet me tomorrow?
I wanted to talk to you about something.
(INDISTINCT CHATTER)
Okay, as your attorney, I'm
begging you not to do this.
But I am right.
You're technically right,
yes, but it's, it's a risk.
I've been reading about this, okay?
Men get acquitted for
self-defence all the time,
but women have to protect themselves
in a way that won't get them killed.
Yes, I know. But
the law doesn't make you invincible.
I don't know, it kind of does.
Okay. Okay. Wait here.
I'll I'll get him.
for 24 hours. At
that point we bring him
- Patrick.
- Hey.
Hey. Uh, do you have a minute?
My client would like a word.
- See ya back at the office.
- Yeah.
I thought I wouldn't
have to see you again
and be reminded of having
- my ass handed to me in court.
- (CHUCKLING)
Uh, well, I was just
I was thinking about
some of the difficulties
you might be having, um,
with the case against Jordan.
- Oh, you were?
- Yeah, so, um,
Jordan's testimony
injected reasonable doubt
into the case against me,
so you dropped it. Right?
- Right.
- Right. So, I was thinking,
what if Jordan's lawyer
brought in a witness,
who, who knew something
of Trey's violence and
his skill at hiding it?
- Go on.
- And that person
could break down on the stand
and confess to the murder.
(CHUCKLING)
And why would someone do that?
Well, they could do it
for any reason, really.
But if that someone were
already tried for the crime,
you, you couldn't go after them, right?
Because that's called, um
- double jeopardy. Right?
- Mm-hmm.
You can't be tried
twice for the same thing.
Are you threatening to do that?
She's just talking about
all the remote possibilities.
- Mm-hmm.
- Are you saying you killed him?
Oh, I didn't kill anyone.
Are you talking about perjury, then?
Because I could hand this
case off to a colleague,
and make myself a witness,
and testify about this conversation.
- He could?
- My clients talking
purely in hypotheticals.
This is not a hypothetical.
There's only one
person that's been tried
for this crime and can't be tried again.
She's just saying that if
something like that happened,
it could create a lot
of confusion for a jury.
Mm-hmm. And there might be
better cases to prosecute
with more deserving victims.
You don't get to decide who's deserving.
No, but you do.
Is this double-jeopardy
thing your idea?
Did you put her up to this?
No, no. I strongly
advised her against it.
Mm-hmm.
But you know she's right.
Oh, I feel so much
better having told you!
It's been keeping me
up at night. Thank you.
Good luck with your decision.
Shall we?
That's a good one.
Oi!
- Hi!
- Jordan!
Hi, Oliver. I missed you.
Can you show me some soccer tricks?
Yeah, sure.
- Hi.
- Hey.
- They dropped the case.
- Yeah.
I don't know how to thank you.
Well, just be there for Oliver.
Oh, you're stuck with me.
Here. You should have this.
You don't have to keep
it, but it's yours.
Oh.
- Thank you.
- Can I see that?
Yeah, just be careful.
My friend made it.
- You made this?
- I wish!
No, it was a friend
from a long time ago.
And besides, Jordan isn't a friend.
She's family.
Yeah.
- Wanna walk?
- Yeah.
