Shark s02e10 Episode Script
Every Breathe You Take
SPORTSCASTER: What a remarkable performance by Christina Shaw.
Just 21 years old, and this her seventh tournament win this season.
Already victorious at the French Open in June, if she can add the U.
S.
Open next month, that will be two majors in one year.
MAN: Christina! I'll always love you, Christina.
And the next thing I knew, I was waking up in my hospital bed.
That was five years ago.
Not a day goes by where I don't think about what happened.
Thank you, Ms.
Shaw.
Ms.
Shaw, you never actually saw your attacker's face, did you? No.
He came up from behind.
It all happened very fast.
So you were never able to positively identifyr.
Franco? No.
ATTORNEY: Thank you.
That's all.
Your Honor, the prosecution never had any direct evidence against my client five years ago-- no fingerprints, no weapon, no eyewitnesses.
All they had was the testimony of Ms.
Shaw's equipment manager, Jonah Ryan, who claimed that he saw Mr.
Franco with his shirt covered in blood.
This aired last week.
MAN (on TV): So you now admit that you never saw Richard Lee Franco that day? I never saw him, but I knew that he probably did it.
He had been stalking Christina for months, so I told the police that I saw him.
MAN: You lied? Yes.
Jonah Ryan died shortly after that interview.
He wanted to come clean before it was too late.
And given that he was the State's key witness, it's clear that he felt pressure to lie.
Your Honor, I prosecuted this case personally.
If Mr.
Kendall is implying that I suborned perjury I'm sure Ms.
Devlin had no idea, but, nonetheless, my client's conviction was based on perjured testimony.
DEVLIN: Well, obviously, we can't question Mr.
Ryan about his alleged perjury, but the fact remains the People would have won a conviction regardless.
Based on what? Mr.
Franco was at the tournament.
He had a history of stalking Ms.
Shaw.
He made death threats against her.
Circumstantial at best.
All right.
Enough.
I'm sorry, Ms.
Devlin, but with colorable proof of perjured testimony, I have no choice but to vacate the conviction of Richard Lee Franco.
In that case, Your Honor, the People wish to refile charges immediately.
We wish the first available court date.
My client looks forward to a speedy trial.
In the meantime, Your Honor, we'd like to be heard on bail.
The People strenuously oppose any bail.
Mr.
Franco is a dangerous and violent criminal.
Mr.
Franco is once again innocent until proven guilty.
And, given that he's spent the last five years in jail because of a lie, I think that he deserves the benefit of the doubt.
Bail is set at $250,000.
This hearing is adjourned.
They're letting him go? I'm sorry, Christina.
I promise we will put him away again.
Christina.
(screaming) NEWSCASTER: Richard Lee Franco is out on bail today, five years after the brutal stabbing of tennis star Christina Shaw.
STARK: It's quite a setup you've got here.
CHRISTINA: After the attack, I retired from competitive tennis.
I didn't know what to do with my time, and it occurred to me, if I wasn't ready to play, I could always teach.
My husband, Kerry, and I started the Academy.
Haven't turned a profit yet, but we're getting there.
You must have your hands full now that you're back on the tour again.
You don't know the half of it.
I just qualified for the Australian Open.
My first major in five years.
See that? You can pick up right where you left off.
I'm taking my comeback one day at a time, especially now.
(sighs) We've got a police tail on Franco.
Unfortunately, there's only so long we can keep that up.
And the Judge wouldn't okay an ankle bracelet.
Great.
So what do I do? We wereable to get a restraining order against him.
I had one of those last time, Jess.
It didn't stop him then.
I can probably get the LAPD to keep a car posted at his house, but beyond that What about your personal security? I have a full-time staff here.
State-of-the-art alarm at the house.
I've got CCTV, a guard who patrols the grounds.
Downer never leaves my side.
(growls) Hello.
He likes you.
You should see him with people he doesn'tlike.
Just to be safe, I'll have our investigator come over and check out your security.
Yeah.
I had a full security team last time.
If there's one thing I've learned, it's that if someone wants to hurt you, they're going to find a way.
We'll get Franco.
And this time, we'll make it stick.
DEVLIN: Isaac, go through the record.
We need Franco's latest psych reports.
This guy's another Hinckley or Mark David Chapman-- disturbed loners who need to destroy the person they idolize.
We've got to make the jury see that.
Then there's her bodyguard, Zach Holbrook.
Madeleine, Raina, reinterview him.
He's the closest thing we've got to an eyewitness.
Danny, talk to his cellmates.
I mean, this guy was in prison for five years.
Anything he said about the attack to any of them is admissible.
We owe Christina Shaw on this one.
I want this freak back in jail.
MADELEINE: Tell us about that night, Mr.
Holbrook.
HOLBROOK: Security's tricky.
Depending on the client, you have a lot of different venues to deal with.
Here, for example, it's not just the stage.
It's backstage, the loading area.
That's why we always make sure the client has a GPS tracker, so we know exactly where they are at all times.
Christina's tracker was in her tennis bag when she entered the tunnel.
A security guard was supposed to escort her to thlocker room.
MADELEINE: Only he didn't.
Christina! HOLBROOK: He stopped to get rid of a photographer.
Christina went on ahead without him.
We knew there would be a 30-second lag when she would be off the GPS because she was underground.
I'll always love you, Christina.
When a minute went by and she wasn't back online, I went in.
And, according to paramedics, she had a severed artery in her leg, and you tied a tourniquet around it, probably saved her life.
Yeah.
Well, if I hadn't trusted stadium security, I wouldn't have had to.
Have you spoken with Christina since he's been released? No.
You do security, you get close to these people for a while, but after that Listen.
I get a Christmas card every year.
That's about it.
If you need me to testify, I am there.
Franco is the reason Christina hired me, and I didn't stop him.
And I'll never forgive myself.
Jess.
What happened? Christina was jogging, saw somebody lurking in the bushes.
She said it was Franco.
ISAAC: Richard Lee Franco is 20 miles away at his house.
Cops posted there say he's been there all day.
That can't be right.
Yeah, well, apparently those cops broke into Franco's house, which means you have a meeting with Judge Cavanaugh tomorrow.
Great.
Yeah.
Now you know how it feels to be me.
I'm really sorry.
Don't be silly.
Christina, Bobby, here, was installing the new sprinkler system by court 12.
Maybe it's him you saw.
No, The guy I saw was wearing a baseball cap.
I don't believe this.
Listen, it's not your fault, okay? The important thing is that you're safe.
Maybe you should check into the Four Seasons Hotel for a while.
They have a celebrity suite there that the Mossad couldn't infiltrate.
No! I won't turn my life upside down for this son-of-a-bitch! Not again.
Look, Christina, why don't you just take it easy? Kerry, don't even start with me, okay, 'cause you don't have the right to.
Not anymore.
Mr.
Conklin, I'm Sebastian Stark, with the D.
A.
's office.
Don't mean to pry, but I was sensing a little tension there between you and your wife.
Yeah, well, she's scared.
Which is why I had my investigator check out her security.
He said it appears that she's living alone.
Yeah.
Yeah, well, we're we're separated, okay? We're in the process of getting a divorce.
Well, I'm sorry.
Been there myself.
Well, then you can understand why we'd like to keep it quiet.
Christina's career is taking off again.
She doesn't need any distractions.
Truth is, we've been drifting apart for some time.
Christina was pretty young when we got married.
It was right after the first trial? Is that right? Yeah.
Yeah.
She needed some stability.
I I guess I was it.
Anyway, we're keeping the business together.
Beyond that, I'd rather just stay out of this.
I'm sorry, but you're a key witness.
You can tell the jury about all the harassment, the stalking.
And I will.
I care for Christina very much, Mr.
Stark.
I want what's best for her.
What part of "innocent until proven guilty" do you not understand, Ms.
Devlin? And where does the LAPD get off forcing entry into Mr.
Franco's home? These were exigent circumstances, Your Honor.
The man's got a phone.
You could have called him.
DEFENSE ATTORNEY: Given the situation, Your Honor, the Defense has no choice but to ask for a T.
R.
O.
against the Prosecution andthe LAPD.
A restraining order against us? You're lucky we're not suing you for harassment.
CAVANAUGH: I'll grant the temporary restraining order.
Ms.
Devlin, call off your dogs.
Are we clear? Yes, Your Honor.
Where are we on the cellmates? Nothing yet, but I do have a lead-- Reuben Gutierrez.
He did six months with Franco for armed robbery.
Paroled last year.
Reuben found Jesus.
Now he's a drug counselor at a halfway house in Pomona.
Great.
Get him in here now.
You should have seen our cell.
Pictures of Christina Shaw all over the place.
Franco used to cross out her eyes with red X's.
Did he ever talk about her? You kidding? He never shut up about her.
Said they were meant to be together, one way or the other.
What about the attack? Did he ever mention that? Franco told me point blank that he tried to kill her.
It was weird because I could tell he felt bad about it, but then he'd tell me that, if they both had to die to be together, he was okay with that.
We got him.
Gutierrez is willing to testify.
And unlike the usual jailhouse snitch, he's not looking for any handouts.
DEVLIN: Great.
I'm on my way to see Christina.
I can finally bring her some good news.
Oh, my God.
STARK: Mr.
Conklin, I'm sorry.
Thank you.
If I had been here Looks like someone busted in and set off the alarm.
DEVLIN: Someone? Try Franco.
STARK: What about the cops we had watching him? He must have given them the slip because they just busted down the door.
Franco's gone.
She should have gone to a hotel like you said.
DEVLIN: This wasn't her fault.
This was my fault.
Jess MAN: I want to assure you that I will put the full resources of my office behind this investigation.
We will pursue this matter vigorously and secure justice for Christina Shaw.
REPORTER: Ms.
Devlin, do the police have any leads on the whereabouts of Richard Lee Franco? You'll have to direct that question to the LAPD.
Well, do you intend to proceed with the retrial of Mr.
Franco? Absolutely.
But right now, our first priority is finding Christina Shaw's murderer.
REPORTER #2: Ms.
Devlin, given the controversy surrounding the first trial, do you feel that you're the right person to be handling this case? CUTLER: I'm offended, actually, by that question.
Jessica Devlin did an outstanding job on that case, and I am completely certain she will get the job done again.
Bad enough she dropped the ball the first time around.
Now the victim is killed right under our noses? The judge screwed us, Leo.
I don't want excuses.
I want her off the case.
Are you that scared of her? Excuse me? Well, you know as well as I do this case put Jessica on the map.
Nobody knew who she was before she put Richard Franco away.
And the next year, she's the District Attorney of Los Angeles.
You're worried that history will repeat itself if she puts him away again.
Let me get Oliver Stone on the phone, because he loves a good conspiracy theory.
News flash: she doesn't want your stupid job, Leo.
This is personal for her.
Yeah, well, it's business for me, so I suggest you find the psycho and nail him ASAP.
Hey, are you almost ready? Sorry.
I just got to get this done.
We're up for this really big project, and I'm helping out with the tech support.
It's fine.
It's good.
It's like a whole new you.
Yeah, well, it's not like the old me was so great.
Actually, I thought he was pretty cool.
So, are we going to Amy's party? I got to get this proposal in first thing in the morning.
But we can go out for a little bit, right? No, you know what? It's fine.
Uh, work is more important.
You sure? Yeah? DANNY: The cops last saw Franco about 4:00 yesterday-- they think he must have slipped out a back window or something.
Priority number one is finding him-- work with LAPD.
I want every available officer on this.
What about his retrial? That's on hold for now.
Right, so what do we have? Well, not much.
Franco ditched the tail, avoided the cameras, the guard, the dog.
The guy's Houdini with a knife.
Reyes.
All right, what else? M.
E.
thinks there was probably a struggle before the attack.
Christina has bruises and there was a strand of hair under her fingernail.
Could belong to the killer.
Great.
Rush that DNA test.
LAPD just cleared a waant to search Franco's place.
All right, I'm heading over there.
What, to oversee the search? Yes.
If there's any evidence, I don't want it contaminated.
And get me that DNA result.
Camp out at the M.
E.
's office if you have to.
(alarm chirps) MAN: Ms.
Devlin? I've been waiting for you.
I never expected all this attention.
The first trial, I mean, I was famous by the end of it.
My face was all over the news.
Right next to Christina's.
Now now we're gonna be famous again.
And you're gonna be a part of it.
Wait.
You think that I'm here to You think that I came to hurt you? No.
I came to turn myself in.
Christina and I, we were meant to be together.
That's what I was always trying to tell her, but she, she wouldn't listen.
And that's why I had to do it.
Do what? Kill her.
You can see that, can't you? So you admit you killed Christina Shaw? Yeah.
Did you try to kill her five years ago, too? I'm not allowed to talk about that.
My lawyer's gonna be mad at me.
Why don't you give him a call? Because I don't need him for this.
It was easy.
Christina invited me in.
So you didn't have to break a window or anything like that? Of course not.
She was happy to see me.
Listen, Mr.
Franco, if you don't want a lawyer, that's good with me, but five years ago, we never found a weapon and this time you dumped the knife in the trash.
Why is that? I turned myself in, Mr.
Stark.
I wanted you to find that knife like I wanted you to find me.
So, uh, when we check that knife for prints, yours are bound to come up, right? I was wearing gloves.
Clever.
Oh, one last question.
Which trash can did you dump the knife in? I think I want my lawyer now.
Yeah.
It wasn't him, Jess.
You're not serious.
He's wrong about the knife, about the window.
Why confess and then lie about the details? It doesn't add up.
What doesn't add up is confessing to something you didn't do.
Not if you are a deluxe nut job.
Captain Crazy in there is obsessed with Christina.
In his twisted mind, he was destined to kill this girl.
Yeah, and now he's fulfilled his destiny.
I am taking him down.
The M.
E.
's office compared DNA from a strand of hair at the scene to Franco's DNA from the first case.
It's not a match.
His story is off, the DNA is wrong.
Come on, Jess.
If it were anybody else they'd be out the door by now.
Not if he tried to kill the same victim five years ago in exactly the same way.
That's just it.
He's the perfect fall guy, and whoever killed Christina knew that.
Everybody in this town wants to string this guy up and be done with it: Cutler, LAPD, you.
And hey, that's okay, except for one tedious little detail.
He didn't do it.
We hang this on him now, we'll never find out who did.
Your case, your call.
Let him go.
You cut Franco loose? We had a confession.
It didn't make any sense.
Yeah, well, that's where you and I differ.
I don't require lucidity from my psychopaths.
If they say the did it, that's good enough for me.
But not for a jury.
Any competent defense attorney could convince them that Franco didn't do it.
Fine.
Then who did? I have no idea.
That's not the answer I want.
I do get points for honesty, though.
You stuck up for Jessica, which was admirable, but now you're on the hook, too.
If this thing goes any further south, you're gonna need a compass to find your way back.
You know, you don't hear enough inspirational camping analogies anymore, Leo.
Thanks for that.
This would be an excellent time for some good news.
I went over the items LAPD logged at Christina Shaw's house.
Yeah? According to her calendar, she had coffee with her former bodyguard Zach Holbrook about a month ago.
I thought he said they hadn't spoken? So I kept looking-- turns out, they met several times over the past 12 weeks.
Why would Holbrook lie about that? I'm heading over there right now to find out.
Well, this time, remind him about the penalties for obstruction of justice.
I'm sorry I misled you.
but my clients rely on me to protect their confidentiality.
Christina Shaw was still a client? She called me about three months ago.
She was worried her husband was having an affair.
And she was correct.
I took these photographs a little over a month ago.
Who's the girl? Tatiana Marikova, tennis prodigy, up-and-comer on the tour.
Christina's husband discovered her the same way he discovered Christina.
Holbrook had proof that her husband was having an affair.
That's why she filed for divorce.
I'll have the alarm company backtrack the logs from the night of the murder.
Now, somebody deactivated the alarm then turned it back on.
Only two people knew the code: Christina and her husband.
So Conklin turns off the alarm, goes in, kills Christina, then turns it back on.
Then on the way out sets off the alarm and breaks a window to put us onto Franco.
Plus he knew the guard's route.
How to avoid the cameras.
And the dog's not gonna attack him 'cause he's family.
Okay, so we know that Conklin could have done it, but what's his motive? Isn't that what the pictures give us? No, the pictures tell us that he was cheating on his wife.
That gives her motive to kill him, not the other way around.
Conklin's new squeeze Tatiana is all over the magazines.
She's the latest "It" girl, and she hasn't even won a tournament yet.
That kind of publicity doesn't come cheap.
Try a $10,000-a-month publicist, but she doesn't come from money.
I checked out Conklin's bank statements.
The guy's barely making the rent.
And Conklin's not making a dime from Christina's comeback.
Yeah, but he co-owned the tennis academy.
Yeah, exactly, and Christina told us they were still in the red, so what if he was using company money to launch the new hottie's career, and what if the old hottie-- who's still his partner-- finds out and then cuts him off? We need to see the financial records of that tennis academy.
I already tried that.
The corporate secretary's also Conklin's accountant, not to mention his lawyer; attorney-client privilege.
Who's the lawyer? Some guy named Rabinov.
(laughing): Lenny? Why am I not surprised? You know this guy? Uh, Lenny Rabinov, something of a local legend, not to mention a moving ethics violation.
My guess is we're not gonna get these records without a court order.
Watch me.
Macallan 18, neat.
How's it going, Lenny? What's it been, five years? Since my third wife divorced me.
Melissa? Marissa.
Melissa was number two.
I couldn't get it straight either.
You know, I can't give you those records, Stark.
Yeah, I figured you might say that.
Salute.
What do we have here? In law school they call that a "summons.
" This one's addressed to you.
You got a date with a special grand jury on state RICO charges.
What RICO charges? Well, the argument goes something like this-- your client embezzles funds, you help him do it, so guess what? Legally, you're embezzling the funds, too.
Hold on a second No, it gets better, Lenny.
This guy Conklin may have murdered his wife.
Wanted to make room for the younger model.
Must've learned that from you.
So you got a choice.
You can go up against the state bar for breaking attorney- client privilege or you can go up against me.
Come on, you're better than that, come on.
Keep that elbow back.
Come strong over the top.
Nice.
Excellent.
Nice snap.
Sorry, kids.
Lesson's over.
Can I help you? No.
But you might want to tell your little girlfriend she's gonna need to find a new sugar daddy.
The tennis academy wasn't an even partnership, Kerry.
Christina controlled 51%, you only had 49.
When she audited the books, she found out you were embezzling company funds.
Those were loans which my client was in the process of repaying.
Come on, we're all adults, okay, Lenny? Lover boy here was skimming from the trough to finance his jailbait girlfriend's career.
I admit I cheated on Christina.
But I loved her.
I would have never hurt her.
I wasn't there.
Right, you were home in bed, alone for a change with nobody to back you up.
Actually, there is someone who can provide an alibi for my client.
Oh, let me guess.
Her? No.
Her.
Isn't that her mother? She manages Tatiana's career.
If I wanted to sign Tatiana Let me get this straight.
You were sleeping with the daughter and with her mother? A: what's your secret? And B: can you prove it? I'll have an affidavit from the mother by the end of the day.
Also, the doorman at my client's building can affirm that he never left the building that night.
Christina certainly got her money's worth when she hired Holbrook to take these pictures.
Hold on.
Christina didn't hire Zach Holbrook.
He came to her with these pictures.
He's been trying to weasel his way back into her life ever since she dumped him and married me.
No problem.
How can I help you? As you may have heard, Richard Lee Franco approached me in the parking lot of my office.
You all right? Yeah, I'm fine.
I'm just worried that with Christina's death, he's transferred his obsession to me.
Fits the M.
O.
of a stalker.
It's not about the specific person, it's about the fixation.
Obviously concerned about my safety.
I know there's only so much the police can do to protect me.
Well, that's why I'm here.
We have a standard retainer agreement.
And I can get the documents.
We can go over your options.
That's perfect.
Thank you.
Here's the paperwork you asked for, Mr.
Holbrook.
Thank you, Gina.
MADELEINE: The DNA test came back.
Holbrook's hair is a match.
Got it.
Zach Holbrook.
Can I help you? You're under arrest for the murder of Christina Shaw.
This is becoming a regular thing with us, Mr.
Boyd.
How can I help you? I know what you're trying to do for my son.
But believe me, you are not doing him any favors.
All I did was get Trevor a job.
My daughter says he's doing great.
It's not your place to intervene.
Well, you cut him off.
Whose place is it? Did it ever occur to you that there's a reason we're taking a hard line with Trevor? He needs to bottom out, and when he does, he'll finally admit that he needs help.
Look, I didn't mean to interfere.
But from what I'm hearing, this has been good for him.
Do you think that I've never gotten him a job? He can't handle it.
It just becomes another obsession.
I've seen it before.
Maybe this time will be different.
Why, because you had a hand in it? Look, if you're not getting through to him, maybe someone else can.
This isn't a trial, Mr.
Stark.
This is my son's life, and I would appreciate if you would stay the hell out of it.
After we got married, Mr.
Holbrook kept trying to contact Christina.
He came by the house all the time.
He just wouldn't leave her alone.
So you were aware of their relationship? Christina said she had ended it, but Mr.
Holbrook was never able to accept it.
Thank you, Mr.
Conklin.
No further questions, Your Honor.
Mr.
Conklin, did you ever see Mr.
Holbrook exhibit any violent or threatening behavior to your wife? No.
Did he ever attack her? No.
In fact, isn't it true that when she was stabbed five years ago, it was Mr.
Holbrook's quick action that saved her life? Yes, that's true.
Didn't Richard Lee Franco commit that attack five years ago? Objection.
Relevance.
Sustained.
Do have any idea where Mr.
Franco was the night that your wife Objection.
Calls for speculation.
Sustained.
Withdrawn.
In light of Mr.
Franco's previous confession Objection.
Your Honor, move to strike.
The jury will disregard that last comment.
You're pushing it, Ms.
Pierce.
My apologies, Your Honor.
Nothing further.
They're trying to pin this on Franco.
Yeah, what was your first clue? Once we call the M.
E.
to testify about the DNA match, the jury will forget all about Franco.
Your Honor before the People call their next witness, I'd like to be heard on a motion in chambers.
Defense moves to strike any DNA evidence that the People intend to present.
On what grounds? Fruit of the poisonous tree, Your Honor.
We obtained Mr.
Holbrook's DNA legally upon his arrest.
We have a signed consent.
But you only arrested him because you already knew the DNA was a match.
May I, Your Honor? My client keeps a hidden security camera in his office.
As you can see, the People illegally obtained a sample of my client's hair prior to his arrest.
We had ample justification for arresting Mr.
Holbrook.
Be that as it may, Ms.
Devlin, this is the kind of stunt I'd expect from Mr.
Stark, not you.
The DNA evidence is hereby excluded.
And consider yourself lucky I don't report this to the bar.
Given the ruling, Your Honor, the defense moves to dismiss.
You've got to be kidding.
The People have no eyewitness, and without the DNA, there's no physical evidence against my client.
Not to mention the fact that someone else has already confessed to this murder.
Your case is extremely thin, Ms.
Devlin.
I'll give you 48 hours to produce new evidence.
After that, I'll be forced to dismiss with prejudice.
DEVLIN: We need something now or Holbrook's going to walk.
We know they're gonna try to pin the murder on Franco.
Wouldn't you? It's a smart move.
I've been trying to establish an alibi for this guy.
So I ran his cell phone records.
20 minutes before the murder, Franco placed a call to Christina Shaw.
Which tells us what exactly? The call registered on a cell tower half a mile from Christina's place.
I think Franco was there.
Why didn't we find this out before? There was no reason to.
Stark cleared him, remember? And he was right.
There's no way Franco killed her.
Not with the story he told.
But he might have seen something.
You want me to use Franco as a witness? The guy's deranged.
Well, he might be all we've got.
Now we just need to find him.
Yeah, well, finding him the easy part.
Look, I had LAPD pick Franco up.
He bolted, it turned into a chase.
It ain't over yet.
REPORTER: The Shaw Tennis Academy where police are engaged in a standoff with recently released celebrity stalker, Richard Lee Franco.
Call Stark, tell him to meet me over there.
Kevin.
Hold on.
Jessica.
Commander Gage, Sebastian Stark.
I think we shared a hostage crisis once before.
Listen, we need to talk to this guy.
GAGE: Hold for my signal.
I repeat, do not fire until I give the signal.
Look, we got a lunatic with a gun and bystanders on the premises.
Protocol is clear.
We take him out before he can hurt someone.
And ordinarily, I'd be fine with that.
But this particular lunatic may be the only witness to a murder.
I'm sorry.
I just need five minutes with him.
If anybody gets hurt, it's gonna be me.
And the upside is, you might get out of here without firing a shot.
All right, stand down until further notice.
I repeat, we are standing down.
Thank you.
Wait, listen.
If anybody's gonna talk to this guy, it should be me.
Forget it.
I'm the one he came to.
He knows me.
Jess, it's too dangerous.
I appreciate the chivalry.
But the fact is, I have a better chance of talking him down than you do.
He came to me.
All right, fine, but, Jess, listen to me.
This guy's feeling cornered.
At the first sign of trouble, get out fast.
Richard.
Ms.
Devlin? Richard, put the gun down.
No, I can't do that, Ms.
Devlin.
I know you cared about her.
I cared about her, too.
It was always Christina's dream to open a place like this.
Yeah.
I saw her in the news conference when she announced it.
She was so beautiful.
You didn't kill her.
Did you, Richard? It was supposed to be me.
I love her so much.
That's why you're here, isn't it? To be close to her? If death is what it takes for us to be together, I'm ready.
No, Richard.
You don't want to die.
You've got unfinished business to take care of.
What are you talking about? Someone took Christina away from you, and I need your help to make them pay.
It's what Christina would want.
Do it for her, Richard.
Give me the gun.
MAN: If he raises his gun, you take him down.
Do you hear me? Immediately.
Take him down.
Give me the gun.
Take him! Get down on your knees! Put your hands in the air! DEVLIN: Don't hurt him.
DEVLIN: You know they're gonna go after Franco on cross.
Then you're gonna have to humanize him for the jury.
You can do it.
You got some kind of weird bond with this guy anyway.
If anyone can keep him focused up there, it's you.
Ah! Here we go.
Don't hold your breath for a pep talk.
Do you really think the best way to win this case is to put Lee Harvey on the stand? News flash.
He wasn't our first choice, Leo.
This whack job just got done playing chicken with the cops on national television.
He confessed to the murder, and, as luck would have it, tried to kill the same victim once before in the same manner.
I take full responsibility, Leo.
Count on it.
So, let me get this straight-- you didn't kill Christina Shaw.
No.
But you admitted to it; you confessed to Miss Devlin, didn't you? Yeah, but Well, which is it? Is it yes? Or no? It's no.
What about five years ago? You tried to kill her then, didn't you? (stammering) You spent five years in jail for it, right? Yes! Allow me to read to the court from Mr.
Franco's psychiatric report while in jail.
"Mr.
Franco suffers from psychotic delusions "punctuated by episodes of extremeviolence.
"This board considers him a danger to others, especially to Miss Christina Shaw.
" No.
They don't know me.
Okay? I loved Christina.
I Okay.
Mr.
Franco, let's try this again.
When you took the bus from your house, where did you get off? Sunset and Beverly Glen.
That's the closest stop to Christina's house, and I walked from there.
And what did you do when you got there? FRANCO: I hid and I watched.
and when I saw her, I called her from my cell phone.
I wanted to tell her how beautiful she looked.
And did she answer? I hung up before she had a chance to, because a car pulled up to the driveway and someone walked up.
And who was it? Him.
He walked up to the door and Christina let him in.
And how did that make you feel? PIERCE: Objection! Relevance.
Your Honor, Mr.
Franco's state of mind is crucial to establishing his credibility.
JUDGE: Overruled.
How did you feel when you saw Zach Holbrook go into Christina's house? It made me feel angry.
I mean, I was supposed to be there, not some pathetic security guard.
He tried to keep me away from her once before, and he failed.
So what did you do then? I went in closer to get a better view.
And what did you see? Um They were talking.
He tried to get closer to her but she pushed him away and then he tried to kiss her and she yelled at him, and then that's when he hit her.
She was clawing at him and they were screaming at each other, and then he, he knocked her down, and I guess when she fell, she must have hit her head, because she wasn't moving.
and he started to panic, and that's when he, um that's when he went and got the knife.
And what did he do then? Mr.
Franco? He stabbed her.
He just, he kept stabbing her and hurting her.
And why didn't you try to help her? I don't know.
I couldn't move, and, and I knew that you would be looking for me, so I just, I ran.
Mr.
Franco.
Richard.
If Zach Holbrook killed Christina Shaw, why did you confess to it? Because she was mine.
She belonged with me, not with him.
I loved her.
Your witness.
You attacked Christina Shaw five years ago Yes or no? Yes.
You stabbed her.
Yes.
Tried to kill her? Yes.
Because in your sick, twisted mind, you were in love with her, weren't you? I still am in love with her.
And she's in love with you, right? You confessed to this murder for one, simple reason, Mr.
Franco.
You killed Christina Shaw, just like you tried to five years ago.
You finished what you started and you wanted the whole world to know about it, isn't that right? No.
You killed her, didn't you? No! He took Christina away from me.
Christina Shaw was a vibrant, beautiful woman.
A tennis star.
A celebrity.
Like all stalkers, Richard Lee Franco wanted what he could never have.
And it was this twisted desire that first brought Zach Holbrook into Christina's life.
Zach Holbrook, security guru to túc stars.
Christina's protector.
Her savior.
Her lover.
Until the threat was gone, and she decided she didn't need him anymore.
But Zach Holbrook couldn't let her go.
He never stopped trying to get back into Christina's life.
In fact, it was Mr.
Holbrook who exposed her husband's infidelity.
But that still didn't bring him any closer to Christina.
And then a gift fell into his lap.
The perfect opportunity to win her back.
Richard Lee Franco was released from prison.
Suddenly, Christina was vulnerable again.
She needed him again.
And she would love him again.
Zach Holbrook went to Christina's house that night assuming that in her hour of need, she would welcome him with open arms.
and when she didn't all the rage that he'd carried for so long boiled over, and the man sworn to protect Christina Shaw became even more dangerous than the stalker who had tried to destroy her.
Zach Holbrook decided, if he couldn't have her, no one else would either.
He murdered Christina Shaw.
For her sake for her memory don't let him get away with it.
In the matter of The People v.
Zachary Michael Holbrook, on the charge of first degree murder, has the jury reached a verdict? We have, Your Honor.
We find the defendant guilty.
(sighs) You all right? Yeah.
So, my client gave you what you needed.
The question is, what are you gonna do for him? What are you looking for? Drop the original case.
STARK: We'll drop the charges if he agrees to involuntary commitment in a state mental facility.
If I go into a place like that, I might never come out.
You need help, Richard; I think you know that.
You're not gonna get it in a prison.
You helped Christina get justice today.
Now help yourself.
Thanks to Yyets.
net
