And defense moves for an immediateprobable cause hearing.

-Ah -What the hell was that? I don't know.
That woman I hallucinated.
Sh-she turned into a transvestite.
-Billy, he is a transvestite.
-I have no idea -That is a man?-Yes.
-But he's so beautiful.
-Really? And, man or woman, what the hell are you doinghitting on him or her? We can't.
What are we going to do? -Mr.
Cage!-Mr.
Cage! Hold on.
Quiet down.
We'll tell you what's going on.
He is being charged withmudering Mr.
Schoefield, as you know.
We don't know the evidence.
We should learn moreat the probable cause hearing.
Evidently, they plan to call Mrs.
Schoefield.
She did it.
-Wh-why would you say that, Mindy?-Well, it it's always the wife.
Yeah, yes.
Uh look.
Normally,I don't call witnesses at these PC hearings, but, uh, since Paul has an alibi, -Benny, I may put you up there.
-Me? Why? Well, to testify that you two were at the movies.
-You were at the movies, right?-I-is that what Paul said? Never mind what he said.
Were you at the movies last nightwith Paul Potts? -Sure.
-We were all there with him.
Hey, this is a murder here! This is not some game! -Were you with him last night or not?-No.
Maybe we should plead insanity.
Ling already calls him mental.
With the way he claps his hands, can we get him declared legal, uh, retard? I don't think that's an option.
John, if he did it ---- He couldn't have done it.
Besides, if we plead out, we won't be able to suppress the knifewith that constitution thing.
Look.
S-seriously, the guydoes seem a little off.
How well do you really know him, him, him, him, him? Re-really, John.
Let's just talk to him beforemaking any decisions.
Paul, we spoke to Benny.
You didn't go to the movies with him.
-Why did you tell us that?-Well -YOU LIAR!-Damn, Richard! -I read that if you catch them off guard -----Well, just stop it! -Where were you last night?-Home.
Why didn't you tell us that before? I was afraid if I had no alibi,I was afraid what the police might think.
Everybody knew I was mad at him forfiring me.
If I had no alibi I just got afraid.
I thought maybe Benny wouldcover for me.
I was You were afraid.
SO, YOU DECIDED TO LIE?DID YOU KILLED THAT MAN? Just get out! Good cop, bad cop.
Pulled a knife out and ---- Choir! Well, I, I think he means "quiet.
" You know? -What is with you?-Nothing.
I'm just, uh -Nervous.
-Nervous? Over what? -You got the Hallen meeting at four.
-Oh, right.
-Billy, what's the matter?-Nothing.
Sandy, you're right, I'm just a little nervous.
Big meeting, biggest client.
Wish me luck.
-Are you nuts?-Oh Uh, I thought, uh uh Marry me!Divorce me! Marry me!Divorce me! Marry me! Marry me! Marry me!Divorce me! Divorce me! Divorce me! Aaahh!!! Uh I think, uh I think I should go see a doctor.
-Ally!-What's going on? He did it.
-He says he was home alone.
-Well, what happens now? Well, we proceed with the probablecause hearing and see what the evidence is.
This isn't good, is it? It Let's just go in.
He doesn't want any visitors.
Sandy -- isn't it?Yes.
Sandy, I'm not sure what theproper protocol is for secretaries, I've never been one.
But I doubt itcalls for referring to the lawyers who actually work in the firm as visitors.
Or hadn't you noticed I work here? I've noticed.
The kiss was just so good,I had to come back.
I am sorry, Nelle.
Listen.
You mentionedyou should see a doctor.
I think that's a good idea.
Lisa Pontel, she's a friend.
She's also an extraordinary neurologist.
Neurologist? Well, it seems more thanjust psychological, Billy.
I set up an appointment for four o'clock.
Well, I can't at four.
I have a meeting with Hallen.
Well, I'll cover the meeting.
Well, he's my biggest client.
If I don't show up ---- And if you take that meetingin your current state, you'll lose him.
Go see Dr.
Pontel.
I'll meet with Hallen.
We were getting ready for bed.
It was about nine-thirty.
And I decided to take a shower.
And where was your husband? He was in the bedroom.
He had started to watch television.
And you took a shower? Yes.
I, I like to take a nice, hot showerbefore I go to bed sometimes.
Um, I got in and I started to wash.
Then I heard.
.
Well, it sounded like thebathroom door closing, which was odd because I thought it was closed.
And I felt.
.
I suddenly felt I wasn't alone.
I called out to my husband, but there was no answer.
And then, I said,"Is anybody there?" Nothing.
And I started to get scared.
I froze.
I justhad this feeling somebody was in the room.
I looked out.
We have a big master bathand connecting closets.
So, I couldn't see everything.
Plus the steam.
The room was full of steam.
I thought, "It's my imagination.
"So, I went back to washing my hair.
Then, I heard something hit the floor --somebody was there.
I called out, "Joel!"But there was no answer.
So, I turned the water off.
I heard nothing.
I looked out again.
Nothing.
I thought again, "It had to be my imagination.
" So, I turned the water back onand started rinsing my hair.
And then, I saw the curtain move and suddenly the curtain is pulled back AAAAAAAH!!! Mm Uh Sorry.
Eh, continue, Mrs.
Shoefield.
Uh, there was somebody in a hood,a mask, with a knife.
He reared back as if to stab me.
And then, he stopped and ran away.
-And what happened next?-I jumped out, I screamed for my husband.
I threw my robe on, called 911 on the phone.
I told the police there was an intruder.
Then, I went looking for my husband.
And I discovered him in the bedroom.
There was blood everywhere.
He was he was dead.
Dead.
Mm, Mrs.
Schoefield, did you seeor hear anything else that night? Yes.
I heard somebody runningdown the stairs, and I heard clapping.
Clapping? Yes.
Twice.
I heard four crisp claps.
Like this.
Exactly like that.
Paul, we're going to go back with the lawyers, maybe come up with some ideas.
-Okay.
I have to stay?-Y-yeah, they won't let you out.
How long before they have a verdict? Well, this is just a probable cause hearing.
-I-it's not a trial.
-Okay.
-Paul, are you okay?-I'm fine.
You knew this was justa probable cause hearing.
I forgot.
I know I'm not a lawyer, buthow come you didn't cross-examine? -Nice scream, by the way.
-Thank you.
I didn't want to cross-examine becauseit's just a probable cause hearing.
I didn't want to tip the prosecutionas to where we might be going.
Not that we have any idea.
So, what happens? He goes to trial? Well, I've reserved the right to call a witness.
Not that I know what good it'll do ---- Mr.
Cage, if this goes to trial,he'll stay locked up till then? Yes.
-And how long before the trial will start?-Well, three, four months.
Well, he'll never make it.
He's already twitching more.
We got to get him out.
It's a homicide, Benny.
The judge won't set bail.
Any way we can beat thisprobable cause thing? Well, their whole case is the clapping, and that's hardly air-tight.
But I, I Possibly.
Well, he'll disintegrate in jail.
W-we got to try to get him out.
May I just throw outan annoying little question? If Paul didn't do it, then, who did? There was no robbery.
The wife.
Yeah.
Well, it's always the wife.
Thank you, Mindy.
She may have had motive.
-Which was?-Well, there was talk.
What kind of talk? Mr.
Schoefield was having an affair.
An affair with who? Her name is Nancy Raleigh-Siclen.
She works with us Well, we used to work with heruntil Schoefield fired us.
And she and Mr.
Schoefield, uh ? Well, the romor was, he wasgoing to leave his wife for her.
They would disappear behind closed doors.
Ask Paul.
He saw it.
Made him very upset.
Upset enough to pick up a knife? -Richard!-Bygones.
We need to talk to this Nancy Raleigh-Siclen.
I'm begging you,it has nothing to do with that ---- Ms.
Siclen, if you're sleeping with this man How does that have anything to dowith whether Paul Potts killed him? -Did Mrs.
Schoefield know of this affair?-Oh, god.
You're going to air this all out? -We need you to come to court with us.
-Oh, god.
You probably won't have to testify, but just in case.
Oh, god.
Is that what you say while sleeping with him? I'm going to be sullied.
Mr.
Hallen, Nelle Porter.
Very nice to meet you.
Where's Billy? -We've taken Billy off this case.
-Why? I like him.
Mr.
Hallen, Billy Thomas is a gifted litigator.
But this is a corporate account, and -- I hope you'll forgive my modesty, but I'mthe top corporate attorney in this department.
If you're happy with Billy,I'd be inclined just to let things be.
But this nonsense with the Billy Girls,it's beneath the integrity of this firm.
It's beneath your own integrity.
And frankly, it doesn't serve you.
Whatever surge of adrenalineyou may get in your genitalia, advertising is foremostabout appealing to women.
I don't need to tell you that.
Look.
You're a big account, you can do what you want.
If you're intent on staying with Billy, fine.
He can certainly do an excellentjob for you.
But you can do better.
Where is Billy? Oh, he's at an appointment with his neurologist.
He suffers some occasional imbalance.
Oh, but I assure you, it's nothingthat would ever affect his work.
-Any headaches?-Not really.
-How long ago did the hallucination start?-Last couple of days.
Hmm.
Any erratic behavior? Well, my friends and coworkers, they think I've been erratic.
How so? Well I seem to have a quicker temper, I've become more chauvinistic,I Oh Different stuff.
Well, I also get funny tastes in my mouth.
-Like the taste of your own foot?-Excuse me? I said, "What kind of tastes?" I don't know.
It's, uh, no-nothing I can identify.
I'd like to run a few tests.
Send the Hallen files to my office, please.
-Elaine.
-She's up to something.
Paul, what do you know about Schoefieldand Nancy Raleigh-Siclen? Not much.
There was something privategoing on, but I don't know what.
-Were they having an affair?-I don't want to get Nancy into trouble.
Paul, you're the one who's in trouble here.
So, if you know something, you need to tell us.
You don't need to repeat itthree times.
Just tell us once.
Nancy just said that there was a problem, but she didn't tell me what.
Other than the clap, you knowof any reason to suspect Paul Potts as the person who killed your husband? No.
You know of any reason my clientwould want to kill him? Well, Joel fired him.
For which, Paul Potts sued, seeking a remedy in court.
Now, do you know of any other personwho might want to harm your husband? No.
Were you angry with your husband,Ms.
Schoefield? Excuse me? Hm.
Uh, who is that womansitting right over there? That's Wanda Mitt, my cleaning lady.
Okay.
Now, who is this womansitting right back over there? That's a woman who worksfor my husband's firm.
You know her name? Wanda Mitt heard you usingthat woman's name two days ago, when you were fighting with your husband.
What is this? This is defense counsel asking questionsof the lead prosecutorial witness, the only prosecutorial witnessto establish probable cause.
Now, is it all right with you, Ms.
Kettering,if I proceed with my questions? Let's just move along.
-Who is this woman, Ms.
Schoefield?-Her name is Nancy Raleigh-Siclen.
And were you angry with your husbandtwo days ago with regard to this woman? Yes.
What about? Well, in fact,he was about to leave you for her.
-That's why you were fighting?-He was not going to leave me.
You were angry.
Perhapsyou picked up a knife.
Perhaps you, you walkedinto the bedroom with that knife.
-That is ridiculous!-Oh, is it? Slowly, you approached him from behind.
He was hanging up his clothes.
He didn't see you.
And you came closer, and closer still.
You raised the knife over your shoulder, you inched closer, and just as he turned around ---- AAAAAAH!!! HAAAH! Ooh-aah! Mm-mm-mm.
Uh, uh, sorry, sorry.
Uh, it just, um This is so outrageous! Hop in the shower, wash away the evidence! Mr.
Cage! The evidence agaist her is just as strongas the evidence agaist Paul Potts.
Potts, Potts! And they hold him simplybecause she says she heard clapping.
With no other evidence, that is a sham, Your Honor.
An absolute sham, sham, sham! We have other evidence.
We just haven't introduced it yet.
Oh please.
What other evidence? A pen, found at the scene.
With Paul Potts' finger prints.
Mr.
Cage, step up here, please.
I find probable cause to exist.
Your client is bound over for trial.
Can you tell me how your pen got there? No.
Paul, you'll be on trial for your life here.
I ask you a pretty important question,a question that you really need to have an answer for, and you just say, "No.
" -No, thank you.
-Okay.
Um You lied to John and Richard aboutbeing at the movies.
I need the truth here.
-Did you kill Mr.
Schoefield?-No, thank you.
-Are you trying to be funny?-No, tha -No.
I'm scared.
-Okay.
Tell me why you think you'rebeing accused of this crime.
'Cause Mrs.
Schoefield heard clapping, and 'cause I'm a freak, and people think that freaksare capable of doing awful things.
But I didn't kill anybody.
I could never.
I'm just a freak.
That's all.
I'm not a mean or violent person.
And you're not a freak, either.
Hey, hey, hey.
Uh well, could you have left a pen of yoursat Mr.
Schoefield's house ever? No.
I was never invited to go there.
Am I going to stay in jail forever? This is why we don't do murder trials.
We stink at them.
Well, look.
They still don't haveenough to convict him.
A few claps and a pen isnot enough to get him convicted.
Places him at the scene, Ally.
That's pretty compelling.
Maybe it was suicide.
Schoefield couldn't havethe woman of his dreams, he's stuck with the wife.
So, he, he stabs himself four times.
What did he do with themurder weapon? Eat it? Mm-mm-mm Wait a second.
Maybe, it wasn't that Schoefieldcouldn't have the woman of his dreams.
Maybe, it was Nancy Raleigh-Siclenwho couldn't have the man of her dreams.
What?? Well, there's something about her.
And she certainly had access to Paul's desk.
She could have lifted that pen.
And she knew about the clapping.
Ah! Maybe she was in the hoodand mask, maybe she killed Schoefield.
Oh please Now, Paul said that he talked to herthat day.
She called him.
Maybe to see if he was staying at home,so he wouldn't have any alibi.
Well, it's conceivable.
Maybe he promised to marry her, and then, suddenly he went back to the wife.
-Well, how could we ever prove that?-Mm, maybe I could get her to admit it.
Yeah! Call her, John.
I could wear a wire.
Don't look at me like that! If there'sone thing I'm good at, it's getting people to talk abouttheir broken hearts.
==, show, show me yours, I'll show you mine.
I do that with my penis, but it's not ---- But, and when I was in sixth grade,th-th-there was this, um, boy who stole all of the teacher's pencils, and she wanted to make thewhole class stay after school.
And I broke him down.
Got him to confess.
This is a murder case.
You're talking about stolen pencils.
John, there's something about that woman, and I can get people to talk.
Now, now, now, I'll go see her,I'll wear a wire.
I, I know it sounds ridiculous.
But, but, but if I can even get herto tip her hand, well, what's to lose? Your life perhaps, if she is the killer.
Oh.
Well, well, well, you guys will listen outside.
All I can tell you is thatthey're working on this.
Working on it how? Well, they didn't fill me in,but they do have a plan.
What's going on, Elaine? They just said that you canall wait here in the meantime, and that they are workingon it, as we speak.
Testing One two three, testing.
-Ghhr.
Can you hear me?-Uh, yes.
We hear you, Ally, loud and clear.
John, is this silly?I mean, I mean, even for us.
It won't be silly,if she gets something.
Can you hear us, Ally?.
Aah! Ah! I, I, I hear you! Okay.
I'm almost at her townhouse.
Uh you two might want to bea little less conspicuous? Oh, all right.
Yeah, we're pulling over.
Nancy, hi.
Um, I'm Ally McBeal, Paul's lawyer.
-We a-actually met yesterday, briefly.
-Oh, you're the one who screamed.
Y-yes.
Um li-listen.
Could I, uh talk to you for a second? Um you know, this reallyisn't a good time.
Sorry.
Oh, no.
Plea-please.
Uh, I know you care about Paul.
And well, I, I promise thatI won't take up much of your time.
Um give me a second.
She's, she's ditching the knife.
Well, I'm, I'm just trying to go with it, John.
Come in.
-I'm sorry about Paul.
-Uh yeah yeah.
Es-especially since I think he's innocent.
So, what did you want to talk about? Well, I would like to talk to youabout Joel Schoefield.
Be sure to look around.
But that's why she went in there, John.
-Shhh!-What's wrong? -Uh, m-mi-mi-migraine.
-In your ear? Mm.
Mm.
Listen.
I I don't know if you loved Joel.
But something tells me you did.
-What business is this of yours?-Well, there was a man I once loved.
You'll hear this pounding sound like a drumwhen we take the pictures.
-Try to keep your head still at all times.
-I get a little claustrophobic in tunnels.
Just let me know if you get uncomfortable.
-Ready?-Hh Yeah.
His name was Billy.
We were soul mates.
We liked the same music, the same food Lah, lah, lah, lah, lah We would laugh together, we we cried together.
And when I lost him, I I was so sure my life was ruined, that, that, that would never be ---- Wait.
Why are you telling me this? Because I don't believePaul Potts killed Joel, Nancy.
And if he didn't, maybe Debra did.
Maybe the thought of losing Joel Maybe it was too much.
But she wasn't losing him.
Were you losing him, Nancy? What are you asking, Ms.
McBeal?Did I kill him? Ooh.
Catches on quick.
Shh! The reason I was telling you about Billy -- it taught me hurt in such a profound way that that I can recognize it now, Nancy.
I can see it in others.
I can see it in you.
You're actually in my houseaccusing me of murder.
Actually, I'm in your housetrying to save Paul.
I, I have no interest in getting you.
Mm, mm, hm, mm, hm hm.
I know you called Paulthe day of the murder, perhaps to assure yourself that he washome alone that night with no alibi.
You could have easily grabbeda pen of his from his old desk.
It still sits there at work.
You knew how he clapped.
I have enough to at least get the policeto investigate the possibility.
And and once they start doing that ---- Are you crazy? I, I am not trying to implicate you, Nancy.
I only want to exonerate Paul.
If you thought I were a killer, Ms.
McBeal, why on earth would you allowyourself to be alone with me? Excellent point!Shh! What was that noise? Don't shush me! I didn't hear anything.
-Listen -----No.
I'm done listening.
You know, for your information, I cared very much for Joel.
Perhaps I even did love him.
And for him to be killed with Please leave, Ms.
McBeal, now.
-If I could just -----No! I want you to leave.
Could I use your bathroom first? What? Why? So you can look around?Discover the murder weapon? No! Get out! I'm just trying to help Paul.
Oh, well, in that case, let me be sure to confess.
Uh, I left my purse on the sofa.
-What are you doing?-Aah! Oh! Oh! Ally! Ally? Ally? Debra! Oh my god.
Debra?? Well well y-you and, and,and Nancy together? -Lesbians.
-Wait/Quick! Call 911.
What's going on? I was I I came by to collect my husband's things.
And when you showed up,I was afraid of how it might look.
So, you jumped into a closet? Oh my god.
Oh.
Tha-tha-that, that fightthat the housekeeper heard, it it wasn't you angry at Joel for an affairthat he was having.
He was angry at you for an affair that you,you were having wi-with, with her!? And at work, those sessionsbehind closed doors, he was angry at you for seeing his wife.
-That's ridiculous.
-You did it together!? Let's sit down and have some coffee, Ally.
Oh, um I uh nah.
I,I think I'll be leaving.
-I don't think you will.
-I know karate.
What are you going to do?Hit me? Debra! You okay? Let me see it.
FBI!Freeze! You two, down on the floor! Now!It's okay.
Quick! No FBI?What, I should have yelled, "Lawyer"? Did you hear? They may havecleared the mental one.
Who? The psycho, whose eyes bulgewhen he claps his hands.
I'm so sure he shouldn't belocked up somewhere.
The tubby one in the dress just hit on me.
What? I, I thought, deep down,he was, uh, a woman.
Well, deeper than that, there's a dumb stick.
-What are you up to?-Excuse me? The Hallen file.
And you also poachedthe Skinner file from Richard.
-Does he know that?-No.
But I do.
-What are you up to?-It doesn't involve you, Ling.
You're doing somethingdespicable, I can tell.
You think I'm just going to sit back quietlywhile you just leave me out of it? This place just needsa few changes, that's all.
And? And I need power to make them.
Don't I? Undercover? What are youdoing going undercover? -I just had a hunch, Your Honor, and -----Where is Mr.
Cage? Eh, he and Richard Fish inadvertentlyrepresented themselves as FB I agents, and they're still answering some questions.
-And you say you found killer lesbians?-O-one was in the closet.
It seems the two womendid have a relationship.
And you now thinkthey killed Mr.
Schoefield? At this point, we don't know what to think.
And, given that, Your Honor, the only evidence that they have againstPaul Potts is a, is a clapping sound, and and a pen, which could have gotten thereany number of ways, and and th-th-they don't have enoughto satisfy probable cause.
Ms.
Kettering? In light of this new information,we recommend the charges be dropped.
Quiet! I don't like my courtbeing made into a mockery! Nobody is making it into a mockery! Ms.
McBeal, when justice is affected by you, Mr.
Cage and Mr.
Fish doingundercover work -- trust me when I tell you --a mockery has occurred.
Mr.
Potts, stand up.
The murder charges against youare dismissed without prejudice.
We're adjourned.
-I'm free?-You're free! And, Mr.
Potts, I apologize forthe hardship we've caused you.
-Thank you.
-Uh, thank you.
-Thank you.
-Um, hmm.
-Hey.
-Hey.
What are you doing here? I don't know.
I was walking by,saw the lights on.
I have a brain tumor.
¡¡ ¡¡
The plaintiff is arguing an entirelydifferent scenario.

He wouldn't pinpoint the illogicin this argument Could it be that this omission isa conscious deletion? -Aah! Aah! Aaah!-Aah! Aah! Aaah! -You just scared me!-You scared me! -What are you standing outside my door for?-I wasn't standing.

Cage.
-I, I will.
I'm going to help you.
-I am innocent.
-Okay.
Just calm down.
Murder, murder, murder! Murder What's the evidence? The arraignment is at ten.
I don't know more C-can I go?Well Well, it I've always wanted to do a murder trial, John.
I, I could open and close, cross-examine,move to supress the murder weapon.
What was it? A knife?I can suppress a knife -- -the constitution, uh, thing.
-Er, uhh, er, pokep-pokep-p, er, John! John, Do you, do you ooh! Do you do you have a murder case? I already got dibs.

Look.
Look, listen.
You can both be on it.
-Second-chair, third-chair.
-Ugh Richard and I will cover the arraignment.
If you could help Matthew, find Benny Winter.
-I called, but I don't think he -----Go to his house.
May-maybe he's not picking up.
He's a Paul's alibi.
We've got to ---- No, I am not going to be third-chair!Why am I third chair and he second-chair? I I happened to be a senior partner.
You==.
-Oh, I am a girl, I can't ==.
-The arraignment's less than an hour.
-We have to hurry.
Let's go!-We have to go, let's go! ==.
-No! I am not a puppet! -It's not my fault.
-He said let's go.
Excuse me.
Yeah? I'm sorry, I had to introduce myself.
Billy Thomas.
Has anyone ever told you you are themost beautiful woman in the world? I get it every now and again.
You got something elseyou want to say to me? No.
-What are you doing?-Nelle, why are you in my -I'm in your office? Oh.
-What's the matter? -Huh? Nothing.
I just Nothing.
-Hh! Loon! Richard Fish, for the defendant, Your Honor.
Move for an immediate acquittal, plus cost Waive reading, Your Honor.
Plead not guilty.
-Guilty, guilty, guilty.
Uh, Yout Honor, I remind you thatmy client has a compulsive disorder, -which causes him to repeat words.
-But it's never made him kill! Uh, not guilty, Your Honor.
Not guilty.
The plead is not guilty.
And defense moves for an immediateprobable cause hearing.
Two o'clock.
-Excuse me.
I-is John Cage here?-He's in court, defending the mental one.
The funny-looking people are back.
-Benny!-What's going on? -They think Paul killed Schoefield.
-No.
-Hi.
-Hello.
-Ling, isn't that meeting about to start?-Oh yes, we're late.
-He said "Hi" to you.
-Yeah, never mind.
I have no idea stay.
I'm sorry.
Call me a hound dog,but that Excuse me.
Can I speak to you a second? I know you must be hit on ten times a day.
-Am I right?-Minimum.
-At the risk of offending -----Look, buddy! I'm about to break your face.
-Ah!?-Excuse me, Matthew.
Come with me.
-Thank you.
-Um, hmm.
